1.                     Prepared by: The City of Port St. Lucie and Veranda CDD II, and Veranda St. Lucie Land Holdings, LLC

2.                     Parties: City of Port St. Lucie  ,Veranda CDD II and Veranda St. Lucie Land Holdings, LLC

3.                     Purpose: The purpose of this resolution is to enter into an agreement with the CDD and Veranda for access via Easement to a power supply switch located on CDD property which controls Artwork Lighting and streetlights. 

4.                     New/Renewal/Modified: New

5.                     Duration: In Perpetuity

6.                     Benefits to Port St. Lucie: The Public Works Traffic Division requires access to the power switch for routine maintenance and emergencies.

7.                     Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for access to the easement.

Staff Recommendation: Move that the Council approve the Resolution for the Easement Agreement

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Resolution.

2.                     Move that the Council not approve the Resolution and provide staff with direction.

 

Background: In order to provide proper maintenance, access to the power supply switch that controls lighting for Spinnakers at Veranda Artwork in conjunction with City streetlights is required. An access via easement is the most efficient solution for all parties involved.

 

Issues/Analysis: It will increase safety and reduce liability.
