Executive Summary (General Business): Following FCC Environmental Services, LLC being awarded the contract for solid waste collection, it is necessary to update the City’s Solid Waste Ordinance so that it aligns with the new franchise agreement. The revised ordinance includes updated definitions, service parameters, and other changes to clarify any ambiguous language present in the current version of the solid waste ordinance.

Staff Recommendation: Move that the Council adopt the ordinance as presented.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and propose additional changes to the attached solid waste ordinance and direct staff to modify the document for approval on the Second Reading of Ordinances on September 12, 2022.

2.                     Move that the Council not approve the changes to the ordinance and provide staff direction.

 

Background: In response to Waste Pro terminating the City’s solid waste agreement in March of 2022, the City Manager tasked staff with conducting an expedited RFP process in order to hire a new franchise hauler. On March 21, 2022, the City Council authorized the City Manager pursuant to Section 4.06 (Emergency Purchases) of the City’s Purchasing Policy and Procedure Manual, to secure the emergency purchase of new solid waste franchise agreement(s) that can be mobilized by September 2022.  Pursuant to the Port St. Lucie City Ordinance 35.05, expedited Request for Proposals (“RFP”) #20220061 was issued to establish an agreement with a qualified contractor(s) who will provide Solid Waste Collection Services to the City of Port St. Lucie.  On April 27, 2022, the City Council waived any irregularities in the expedited process relating to Request for Proposals 20220061 for solid waste collection services, approved the short list, and authorized staff to begin simultaneous negotiations for both service zones with the recommended firms. On May 18, the solid waste services contract was awarded to FCC Environmental Services, LLC.

 

In the negotiated franchise agreement based on the recommended service levels as identified by the City’s Solid Waste Task Force and accepted by City Council, the following changes relating to the City ordinance were made:

 

Fully automated garbage collection weekly, fully automated recycling collection weekly, yard waste collection weekly with a limit of four cubic yards, bulky waste collection monthly (two cubic yards), customer convenience/drop-off center (to be operated by the City).

 

Due to these changes, it is necessary to update the City’s Solid Waste Ordinance in order to align it with the new franchise agreement.

 

Issues/Analysis: In summary, ordinance changes include:  a revised definition section that is consistent with the new Franchise Agreement; specifying requirements for general set out provisions; limiting bulky waste to (2) two cubic yards per service; limiting yard waste to (4) four cubic yards per service; specifying requirements for collection containers (garbage carts, container placement, and maintenance & repair of containers); further defining prohibited acts.
