2. Parties: City of Port St. Lucie and Zahlene Enterprises, Inc.
3. Purpose: To bridge the gap between the FDOT project and the City’s project for a consistent roadway section through the corridor.
4. New/Renewal/Modified: Modified.
5. Duration: An additional 3 calendar days are required for a new end date of 6/26/2023.
6. Benefits to Port St. Lucie: The work will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, and underground drainage.
7. Cost to Port St. Lucie (Annual and Potential): The total amount of the Amendments exceeds the threshold and requires Council approval in the amount of $43,836.27. The new Contract amount is $8,052,174.45.

Staff Recommendation: Move that the Council approve Amendment No. 5 to Contract No. 20200077 for the Port St. Lucie Blvd. Segment No. 3 Roadway Improvement Project with Zahlene Enterprises, Inc., and ratify prior Amendments Nos. 1, 3 and 4.
Alternate Recommendations:
1. Move that the Council amend the recommendation, ratifying Amendments Nos. 1, 3 and 4, and not approving Amendment No. 5 to Contract No. 20200077, providing staff with direction
2. Move that the Council not ratify Amendments Nos. 1, 3 and 4 and not approve Amendment No. 5 to Contract No. 20200077 and provide staff with direction.
Background: The Amendments include the following:
• Amendment No. 1 - Additional funds needed to change out the proposed pipe from PVC to Ductile Iron. When using Ductile Iron pipe, it is required to use a polyethylene wrap. This wrap is labor intensive therefore the additional funds will be used for labor to wrap the pipe. Total cost is $8,790.25. No additional calendar days are required. (Not previously approved by Council).
• Amendment No. 2 - Additional funds needed to upgrade the Mast Arm to the 12-sided Mast Arms to match all of the existing mast arms in this corridor. Total cost is $17,904.30. No additional days are required. (City Council approved on June 13, 2022, Item 7.e. - Legistar ID 2022-481)
• Amendment No. 3 - Added 94 calendar days to the contract to allow for delays in procuring materials, inclement weather days and holidays. Total cost is $0.00. (Not previously approved by Council).
• Amendment No. 4 - Incorporate plan revisions to the contract. Plan Revision #1 resolves sidewalk conflict with existing utility pole at the SW corner of Darwin Blvd. and Port St. Lucie Blvd. Plan Revision #2 allows for the installation of an alternative adaptive signal control system other than the Rhythm Manufacturing system specified in the original plans. (Not previously approved by Council).
• Amendment No. 5 - Plan Revision to allow for the construction of alternative slope protection and address locations as noted. Total cost is $19,141.72 and 3 additional calendar days. (Not previously approved by Council).
Issues/Analysis: Staff has reviewed the proposed changes described herein and finds them to be fair and reasonable.
Financial Information: Funds are appropriated in the Road & Bridge CIP Fund / Traffic / Improvements O/T Building / SW Port St. Lucie Blvd. Reconstruction (#304-4121-563000-Y1717).
