2. Parties: City of Port St. Lucie and CONSOR North America, Inc. fka CONSOR Engineers, LLC fka American Consulting Engineers of Florida, LLC (“CONSOR”).
3. Purpose: Amendment #16 - Additional engineering funds are requested to design Water Main (WM) replacements in coordination with the ongoing Phase 3 construction. Amendment #17 - This Amendment is needed to increase in funds for design due to AT&T conflicts.
4. New/Renewal/Modified: Modified.
5. Duration: No additional days are needed for these Amendments. The end date remains 11/19/2027.
6. Benefits to Port St. Lucie: Replacement of aging pipelines alongside the roadway construction path and enter into a separate agreement to reimburse the City due to the AT&T conflicts.
7. Cost to Port St. Lucie (Annual and Potential): Amendment #16 requires an increase of $99,050.00. Amendment #17 requires an increase of $201,521.00. The new Contract amount is $3,246,573.00.

Background: Amendment #16 - The City’s Public Works Department is currently reconstructing Floresta Drive between Crosstown Parkway and Prima Vista Blvd. As part of this effort, the Utility Systems Department (USD) has the opportunity to replace aging water and sewer infrastructure in coordination with the roadway and drainage improvements. While addressing AC line replacements along Arton Lane, USD identified the need to also replace additional Water Main (WM) lines along Harbor View Lane. Completing this work now, in parallel with the roadway project, will prevent the need to return after construction is finished and will avoid subjecting residents to further disruptions. This will also generate saving in both time and cost. The amount of Amendment #16 is $99,050.00.
Amendment #17 - Throughout the design phase, the City has worked closely with private utilities to minimize impacts to their facilities through collaborative design. In 2021, AT&T agreed to reimburse the City for design work undertaken to avoid impacts on a major duct bank running the length of SE Floresta Drive north of Crosstown Parkway. Through many iterations and multiple redesigns, costs were incurred by the design engineer. These costs were tracked, totaled, and verified by the designer, AT&T, and the project team. This Amendment provides the funds to the designer with a follow up agreement to be executed between the City and AT&T for reimbursement. The amount of Amendment #17 is $201,521.00.
Issues/Analysis: City Council approval is required pursuant to City Code of Ordinances, Section 35.09(b), and its predecessor ordinance. Staff has reviewed the Amendments and finds them to be fair and reasonable.
Financial Information: Funds are appropriated in Half Sales Tax Fund / Road & Streets / Improvements O/T Building (#310-4105-563000-00000).
