Executive Summary (General Business): This ordinance includes the application of a city-initiated text amendment to Chapter 158 of the City of Port St. Lucie Code of Ordinances which lists the zoning districts within which mobile food trucks and trailers will be permitted to operate and creates a new Chapter of the City’s Code of Ordinances - Chapter 121- Mobile Food Trucks to establish general operation requirements for mobile food trucks and trailers as recommended by the City Attorney’s Office.

Staff Recommendation: Move that the Council approve the city-initiated text amendment to Chapter 158 of the City of Port St. Lucie Code of Ordinances and adopt Chapter 121- Mobile Food Trucks as recommended.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and adopt Chapter 121- Mobile Food Trucks as recommended.

2.                     Move that the Council provide staff direction.

 

Background: Section 509.102, Florida Statutes generally preempts to the state certain regulation of the operation of mobile food dispensing vehicles (MFDV) and temporary commercial kitchens (TCK) (aka mobile food trucks and trailers), as well as prohibits the City of Port St. Lucie, Florida (“City”) from banning their operation within the entirety of the City.  Currently, Section 158.217 of the Zoning Code restricts mobile vending of food or flowers to a business located in either zoning districts General Commercial (CG) or Planned Unit Development (PUD). Section 158.217(G) Mobile Sales does not address vendors operating mobile food trucks or food trailers within City limits.  The ordinance, if approved, would permit MFDVs and TCKs as accessory uses in the Neighborhood Convenience Commercial (CN) Zoning District under Section 158.120(D), General Commercial (CG) Zoning District under Section 158.124(D), Service Commercial (CS) Zoning District under Section 158.126(E), and Warehouse Industrial (WI) Zoning District under Section 158.135 (D); and Industrial Zoning District (IN) under Section 158.136 (D).  The ordinance, if approved, will also create a new Chapter of the City’s Code of Ordinances - Chapter 121- Mobile Food Trucks which establishes general requirements for operation of mobile food trucks and trailers throughout the city. 

 

Issues/Analysis: On October 29, 2024, a Stakeholder Open House was held for over 35 attendees including food truck owners. Information on the ordinance was provided and certain feedback was incorporated from this meeting.
