Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Robyn Holder, CPPB, Procurement Management Division (PMD).

2.                     Parties: City of Port St. Lucie and Felix Civil Construction, LLC f/k/a Felix Associates of Florida, Inc.

3.                     Purpose: To provide for the final true-up of the project and close it out.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: No additional time is needed to close out the project.

6.                     Benefits to Port St. Lucie: To provide for high quality infrastructure and facilities.

7.                     Cost to Port St. Lucie (Annual and Potential): Amendment #6 was for an additional $80,821.00 and Amendment #7 did not require any additional funds, only added time. Amendment #8 is for the final adjustment to the Contract which requires an additional $807,262.50 for a final contract amount of $32,663,330.56.

Staff Recommendation: Move that the Council ratify Amendments #6 & #7 and Approve Amendment #8 to Contract #20220045 for the Floresta Drive Improvement Project Phase 2 with Felix Civil Construction, LLC.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and ratify Amendments #6 & #7 and approve Amendment #8 to Contract #20220045.

2.                     Move that the Council not approve the Amendments and provide staff with direction.

 

Background: The Floresta Drive Improvement Project is four (4) miles of roadway that was split into three (3) phases due to funding availability. The Phase 2 project includes roadway, landscaping, pedestrian & street lighting, sidewalks, and dedicated bicycle lanes. The project also includes a new pedestrian bridge crossing the Elkcam Waterway and new roundabouts at Polynesian Avenue and Bywood Lane. There are stormwater treatment ponds at Lake Thornhill and Walters Terrace.

 

Amendments 6 & 7 were each (and combined) within the City Manager’s approval authority under City Code of Ordinances, Section 35.09(b), and therefore, were not brought before Council. However, the amount added in Amendment #8 requires Council approval under section 35.09(c), and therefore, staff is asking Council to ratify the previous amendments and approve the most recent.

 

Amendment #6 was to account for the following:

a)                     COR #040 for added irrigation electrical service.

b)                     COR #041 for relocation of pedestrian signals at Crosstown.

c)                     COR #042 for added work street name blades to stop signs.

d)                     COR #043R1 for Glance pre-emption system at Thornhill Drive.

e)                     COR #044 for exploration and removal of organic material in the roadway.

f)                     COR #046 for added work at Floresta Centre and 1782 Floresta Drive.

Total Cost for Amendment #6 - $80,821.00

 

Amendment #7 was to account for the delays associated with the installation of the utility water meters for the irrigation services. The total number of days added was 37 calendar days. No additional funds were added.

 

Amendment #8 is to account for the final true-up of the project:

a)                     COR #048 for added work at Seahouse & Whitmore.

b)                     COR #049 for replacing incorrect Illuminated Sign Panels at Thornhill Drive.

c)                     COR #050 for modification to Elkcam Pond and Structures.

d)                     COR #052 of adding street name blades to yield signs.

e)                     COR #053 for deleting tree diapers and adding clusia hedges at lift station 39/parking.

f)                     COR #054 for addition of pavement markings route shields at Crosstown Pkwy.

g)                     COR #055 for modifications to drain wooded area near Thornhill Pond.

h)                     COR #056 for additional grading and adjust meter boxes.

i)                     COR #057 for added outfall North of Polynesian Ave.

j)                     COR #058 for modifications to new drainage structures.

k)                     COR #059 for modification to oval about.

l)                     COR #061 for patterned pavement seal coat credit.

m)                     True up for pay items overruns and underruns to complete the scope of work in the project plans.

Total Cost for Amendment #8 is $807,262.50.

 

Issues/Analysis: Staff has reviewed the final adjustments to the contract and agree with recommendation to close out the project as indicated above. 

                      

Financial Information: Funds are appropriated in the Half Cent Sales Tax Fund / Road & Street / Improvements O/T Building (#310-4105-563000-00000).

 

Special Consideration: N/A.

 

Location of Project: Floresta Drive from the Elkcam Waterway to Crosstown Parkway.
