Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Midway Glades Developers, LLC.

2.                     Parties: City of Port St. Lucie Utility Systems Department (“USD”) and Midway Glades Developers, LLC (“Developer”).

3.                     Purpose: The purpose of this resolution is to enter into an agreement with the Developer for access to the future Floridan Wells F37, F38, and F39 (“Wells”) located in the development known as “Wylder.”

4.                     New/Renewal/Modified: New.

5.                     Duration: In perpetuity.

6.                     Benefits to Port St. Lucie: The Developer previously conveyed the real property for the Wells; however, the USD requires access to each site to construct, operate and maintain the Wells.

7.                     Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for the acquisition of these easements.

Staff Recommendation: Move that the Council approve the Resolution for the Temporary Utility Easement Agreement for access to the future Floridan Wells F37, F38, and F39.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Resolution for the Temporary Utility Easement Agreement for access to the future Floridan Wells F37, F38, and F39.

2.                     Move that the Council not approve the Resolution and provide staff with direction.

 

Background: Developer is the owner of certain real property located south of Midway Road, West of Glades Cut-Off Road within the development known as “Wylder.” The USD worked with the Developer to acquire three one-acre parcels with the intent, after the conveyance, to design and build three Floridan wells. The wells will be utilized in the reverse osmosis treatment process to produce potable water. These easements provide access to well sites to construct, service and maintain them.

Financial Information: There is no cost to the City for the acquisition of these easements.

 

Special Consideration: These easements provide access to the well sites to construct, service and maintain them.

 

Location of Project: The Wells are located in the development known as “Wylder” south of Midway Road and west of I-95.
