Executive Summary (General Business): Reserve Commerce Centre Association, Inc has provided the necessary items to process a final turnover to the City for existing lighting along Commerce Center Parkway. The Maintenance Transfer Agreement will allow the City to control the maintenance of the facilities in the future and avoid the concerns received from residents on the need for functioning lighting.
Presentation Information: Staff will be available to answer any questions.
Staff Recommendation: Move that the Council approve the resolution accepting the Maintenance Transfer Agreement.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the resolution.
2. Move that the Council not approve the resolution and provide staff direction.
Background: The City received some concerns from residents back in 2020 that prompted City Staff to investigate the current lighting situation at the intersection of Glades Cut Off and Commerce Center Parkway as well as along Commerce Center Parkway in the G.O. Team Industrial Park. The City coordinated with FP&L to have lighting installed at the intersection however there is existing lighting along that portion of Commerce Center Parkway. It was discovered that Kolter requested the power to be turned off to these lights back in 2015. We reached out to Kolter and subsequently received a request from Kolter to turnover the lighting to the City. Kolter was required to update the lighting to LED and make some repairs to bring the lighting back into working order which has been completed. Callaway Land & Cattle Co., Inc. owned land where the lighting was constructed. The current owners are Reserve Commerce Centre Association, Inc. Both parties have executed the Maintenance Transfer Agreement.
Issues/Analysis: The Maintenance Transfer Agreement needs to be accepted by the City for proper maintenance to be achieved on this roadway lighting going forward.
Financial Information: The City will be taking over payment of the FP&L power bills for the subject lighting.
Special Consideration: The Maintenance Transfer Agreement needs to be accepted by the City so that lighting can be properly maintained in this area.
Location of Project: Commerce Centre Drive from east of Reserve Park Trace to just west of Commerce Lakes Drive.
