Summary Brief (Agreements/Contracts only)

1.                     Prepared by: The City Legal Department

2.                     Parties: City of Port St. Lucie and Mattamy Palm Beach, LLC (Mattamy)

3.                     Purpose: Enter into an agreement that establishes a time frame for partial reimbursement of the traffic signal at the Community Boulevard and Discovery Way intersection.

4.                     New/Renewal/Modified: New

5.                     Duration: Perpetual until payment is received as outlined in the agreement.

6.                     Benefits to Port St. Lucie: Facilitating completion of the traffic signal by working with development partners in the community.

7.                     Cost to Port St. Lucie (Annual and Potential): The City will front the cost of the traffic signal installation. After reimbursement by all parties, the City will cover approximately $300,000.00 which is 1/3 of the installation cost for this traffic signal.

Staff Recommendation: Move that the Council complete motion in the affirmative.

1.                     Move that the Council amend the recommendation and complete motion in the affirmative.

2.                     Move that the Council not approve and provide staff direction.

 

Background: A Traffic Signal Warrant Analysis was conducted by Riverland Development Company, LLC in March of 2024 at this intersection. After review and comment from the City’s 3rd party traffic consultant, Kittelson and Associates, the signal was deemed not warranted at that time. Based on the data in the 2024 analysis, the steady growth of new homes in the area, and the opening of new commercial establishments near this intersection (by Mattamy) to the south, the City’s anticipate this traffic signal being warranted very soon, if not already. The City and Mattamy desire to accelerate the traffic signal installation for the betterment of the community.

 

 

Issues/Analysis: Mattamy will reimburse 1/3 of the costs for the traffic signal as set forth in the Agreement within 5 years of completion of the signal. Should the City not approve this Agreement, the City would incur the total cost for the traffic signal. 

                     

Financial Information: The City shall fund the installation of this traffic signal in FY 25/26. Based on this Agreement, reimbursement to the City will occur for 1/3 of the installation cost, within 5 years of the completion of the traffic signal installation.
