3. Purpose: For the City to accept an exclusive perpetual easement, located at 10180 S. US Highway 1, Port St. Lucie, FL, for bus shelter purposes.

6. Benefits to Port St. Lucie: Acceptance of the exclusive perpetual easement located at 10180 S. US Highway 1, Port St Lucie, FL, will support the City Council’s strategic plan, Goal 5, High-Quality Infrastructure and Facilities.
7. Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for this easement.

Staff Recommendation: Move that the Council approve the Resolution authorizing the acceptance of an exclusive perpetual easement located at 10180 S. US Highway 1 for a bus shelter.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the acceptance of the easement.
2. Move that the Council not approve the acceptance of the easement.
Background: Dale and Gail Coyne (“Developer”) are the property owners of the 1.56 Acre parcel located on the NE corner of US Highway 1 and SE Jennings Rd. The Developer has submitted a site plan for a proposed McDonalds Restaurant to be located on the parcel. There is an existing transit bus stop used by Area Regional Transit (“ART”), the St. Lucie County transit provider, located less than five hundred (500) feet east of this parcel. Due to limitations within the right-of-way, it is not feasible to construct a bus shelter at the existing bus stop. An exclusive easement on the Developer’s parcel, located adjacent to the right-of-way will be favorable for a future bus shelter; therefore, the City of Port St. Lucie has requested an exclusive perpetual easement from the Developer, for the construction of a future bus shelter for ART.
Issues/Analysis: The proposed exclusive perpetual easement is necessary for the construction and operation of a bus shelter for public transit.
Financial Information: There will be no cost incurred by the City.
