Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Utility Systems Department (“USD”).

2.                     Parties: City of Port St. Lucie and the Florida Department of Environmental Protection (“FDEP”).

3.                     Purpose: The USD has installed a force main interconnect to transport flow from the Westport Wastewater Treatment Facility ("WWTF") to the Glades Booster Pumping Station.

4.                     New/Renewal/Modified: Modified.

5.                     Duration: The Grant Agreement was scheduled to expire on September 30, 2026. Through this amendment, the agreement was extended for a two-month period to begin October 1, 2026, and remain in effect until November 30, 2026.

6.                     Benefits to Port St. Lucie: The force main interconnect allows for the transfer of wastewater flows during heavy rain, tidal and storm-induced flooding conditions to be treated to high-level disinfection standards and reused for irrigation, reducing discharges to the St. Lucie River and the Estuary Basin.

7.                     Cost to Port St. Lucie (Annual and Potential): The FDEP was originally matching funds up to $8,762,155 for a total estimated project cost for construction of $17,524,310. However, the FDEP recently identified additional funding which covered all construction related costs for this project with no cost to the City.

Staff Recommendation: Move that the Council ratify the City Manager’s execution of Amendment #2 to the Grant Agreement with FDEP.  

 

Alternate Recommendations:

1.                     Move that the Council not ratify the City Manager’s execution and provide staff with direction.

 

Background: FDEP Grant 23FRP13 was approved by the City Council via Resolution 23-R91 on August 28, 2023. This was a 50/50 cost share grant that was originally slated to cover $8,762,155.00. Construction of the force main was completed under budget in January 2026. Due to the project coming in under budget, the City approached the FDEP with a request to utilize construction management costs associated with this project as part of the reimbursement from FDEP. The FDEP approved this request and during project closeout, offered to fund the entirety of the construction including management costs. Total grant funding in the amount of $14,137,594.00 will now cover all construction related costs for this project.

 

Amendment #1 removed Task 1, Sea Level Impact Projection (SLIP) Report, as this is only needed for projects along the coastline. Task 2 and 3 were now within Task 1 due to that removal. Task 3 (which is now within Task 1) was amended for quarterly reporting and updated FDEP forms. There was no change to the project duration.

 

Issues/Analysis: N/A.

                     

Financial Information: The FDEP has identified additional funding in the amount of $5,375,439.00 for this project, bringing the total FDEP funded portion of the project to $14,137,594.00. Thus, funding the total construction and construction management costs for this project with no cost to the City. To date, the City has received $7,059,414.59 under the original grant agreement; with this amendment, the City is receiving an additional $7,078,179.41.

 

Special Consideration: The FDEP had requested this amendment be executed by September 30, 2026, in order to disperse the additional funds.  Given the time constraints (no time to obtain formal Council approval before the deadline), the City Manager executed Amendment to secure those additional funds and is requesting ratification of Amendment #2 of the Grant Agreement.

 

Location of Project: The location of the force main interconnect is protected critical infrastructure information protected by the Critical Infrastructure Information (CII) Act and the Department of Homeland Security.
