Executive Summary (General Business): The City of Port St. Lucie has received a request from Murphy Oil USA, applicant, for a special exception use to allow a 2,824 square-foot convenience store with 12 fuel sale positions, as per Section 158.124(C)(11) of the General Commercial (CG) zoning district for a site located at the northeast corner of SW Port St. Lucie Boulevard and SW Bayshore Boulevard. The Zoning Code specifies a convenience store with a fuel service station may be permitted only following the review and specific approval thereof by the City Council. The site is currently vacant; however, it was approved for and housed a convenience store with fuel service station in 2011.  More recently there was a car wash approved but never built on this property.

This request was previously tabled at the May 27, 2025, City Council meeting to allow staff and the applicant additional time to address traffic concerns. The Public Works team met with the applicant’s traffic engineer to resolve staff’s concerns and have the provided traffic impact analysis revised appropriately. Additional traffic concerns were addressed by changing the access to an ingress only along SW Port St. Lucie Boulevard, with all other access provided through the existing cross-access to the plaza to the north.  This item was readvertised for the August 11, 2025, City Council Meeting.

Staff Recommendation: That the Council approve the Special Exception Use application with the following condition:

 

1.                     Prior to the issuance of the first building permit, a City Gateway Sign easement shall be recorded for the proposed location provided on the conceptual plans in a form reviewed and accepted by the City.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Special Exception Use application.

2.                     Move that the Council not approve the application and provide staff with direction.

 

Background: This site at the northeast corner of SW Port St. Lucie Boulevard and SW Bayshore Boulevard was previously approved for two special exception uses (P11-147 & P11-164) for the approval of a convenience store in association with fuel services back in 2011. The two applications were processed in accordance with the requirements of the code at the time, which required both uses to acquire City Council approval independently. These two approvals were to accommodate the previous Chevron gas station that was constructed under the Chevron Station Site Plan Amendment (P00-092).   In 2019, the site was then approved for a new special exception use (P19-227) and site plan (P19-228) to allow a carwash for a project known as Tommy Car Wash. Under these projects, a sign easement was proposed for the southwest corner of the site to grant the city access to construct a City Gateway monument sign. After the approval of the special exception use and site plan, the owner moved forward with the demolition of the gas station in 2021. However, the owner never moved forward with construction of the car wash and the proposed easement was never recorded and approved.

 

Issues/Analysis: Approval of a special exception application shall only be granted by the City Council if it meets the criteria established under Section 158.260 (A) through (L).
