Executive Summary (General Business): Proposed by artist J. Carvallo, the estimated footprint of the proposed interactive sculpture is twelve (12’) foot in diameter and the estimated total height is 13’- 18’. The piece will consist of multiple vertical elements made of powder-coated aluminum, anchored to concrete subflooring or cast in place. The interior of the vertical elements will feature a polished/mirrored finish. The concept revolves around the use of three (3) offset circles marked with warm and cool-toned vertical elements that symbolize the beach and the sun. These elements will act as walls for a small maze where both adults and children can interact. Visitors will enjoy seeing their warped reflections on the inner faces of the maze walls. The intentional use of an offset Moiré effect in the placement of elements will create a sense of dynamic movement in what is otherwise a static piece. Users can experience the colors and reflections and interact with the piece within its three non-concentric circles.

 

Presentation Information: The artist/applicant will provide a presentation.

 

Staff Recommendation: Move that the Council adopt the resolution to approve the artwork as recommended by the Public Art Advisory Board with the condition that:

 

1.                     A restrictive covenant, binding the property owner’s successors and assigns to retain and maintain the artwork in compliance with Chapter 160, be executed and recorded within ten (10) days of the issuance of the certificate of occupancy for the project.

 

Alternate Recommendations:

1.                      Move that the Council amend the recommendation and adopt the resolution.

2.                      Move that the Council not adopt the resolution and request the 1% payment in the amount of $51,900 into the City’s Public Art Fund, or provide direction.

 

Background: On August 19, 2024, the Public Art Advisory Board unanimously recommended approval of the proposed sculpture. 

 

All private development meeting the applicability requirements of the City’s public art ordinance is subject to a public art assessment of one percent of the total dollar amount of a project’s total construction costs.  The public art assessment is capped at $100,000.  In general, there are four methods available for development projects to satisfy the City’s public art requirements.  The first option is to provide artwork on site.  The second option is to pay a fee in lieu and the third option is a combination of the two.  The fourth option is an Alternative Equivalent Proposal, which allows a developer to apply to combine the public art assessment for multiple projects into one larger work of art in lieu of several small works of art.   

 

The applicant has selected the first option, to provide artwork on site. The project’s estimated cost of construction is $4,517,829.05. The agreed-upon cost of the artwork is $51,900. 

 

Option 1. On-site Artwork. Submit documentation evidencing the escrow of funds for a work of art valued in an amount not less than one percent (1%) of the total construction costs and submit an application for approval of the work of art in compliance with this chapter

Financial Information: The maintenance of the artwork is the responsibility of the property owner.

 

Special Consideration: On September 12, 2022, City Council approved artwork in connection with Gatlin Pointe Phase I, located between the first two (2) buildings in the pedestrian area. The artwork is a sculptural kinetic collaboration piece by the same artist.

 

Location of Project: The artwork will be located on the project site at 1234 - 1244 Gatlin Boulevard, placed in the pedestrian area between Building 3 and Building 4.
