Executive Summary (General Business): Request for City Council to declare and designate City-Owned real property as surplus and approve disposal of the real property through an online auction. The residential real property sought to be declared surplus is located at 206 SE Fiore Bello in Port St. Lucie and is legally described as Lot 23, Block 12, First Replat of River Point P.U.D., according to the Plat thereof as recorded in Plat Book 41, Pages 21, 21A through 21O, of the Public Records of St. Lucie County, Florida (the “Subject Property”).

 

Presentation Information: N/A.

 

Staff Recommendation: Move that the Council approve the surplus designation of the Subject Property and approve disposing of the Subject Property through an online auction at an optimal price.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the surplus designation of the Subject Property and direct staff in the preferred method of disposal.

2.                     Move that the Council not approve the Subject Property for surplus and retain in the City’s inventory.

 

Background: The Subject Property escheated to the City by way of the St. Lucie County Commission. There is no municipal need for the Subject Property. The Subject Property is being presented to City Council for consideration to designate it as surplus and for sale pursuant to City Policy# 18-01ccd.

 

City Policy #18-01ccd requires any asset valued over $15,000 be declared as surplus and the sale be approved by the City Council.

 

Issues/Analysis: All City Departments verified that they have no use for the Subject Property. City Policy #18-01ccd provides for two methods for disposal of surplus real property, auction or Request for Proposal (RPF). The policy further provides the City Council with the right to dispose of surplus real property by any other means in the best interest of the City, upon motion by the City Council. An example would be the use of a Real Estate Broker.

 

Prior to commencement of the sale of the Subject Property, an appraisal to establish the minimum price for the sale is required and notification to all property owners within 300’ of the Subject Property must be notified of the sale by first class mail. Additionally, the Florida Statues require that the City shall advertise the sale of the property in the local newspaper at least 30 days prior to the sale.  All sales, regardless of the method used, must be finalized by an Ordinance in accordance with the terms and provisions of the City Charter Section 9.09(g).

                     

Financial Information: One-time revenue to the City and a potential increase in the tax roll.
