6.                     Benefits to Port St. Lucie: Ensures City is not financially responsible for issues related to commingling of CDD stormwater system with City stormwater system.

7.                     Cost to Port St. Lucie (Annual and Potential): There is no cost to City.

Staff Recommendation: Move that the Council approve the Resolution authorizing the City to enter the Agreement.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Agreement. 

2.                     Move that the Council not approve the Agreement and provide direction to staff.

 

Background: The District desires to connect stormwater drainage pipes to the City’s Wylder Parkway Stormwater System to serve Wylder Parkway together with other lands within the Wylder development. This would comingle the roadway stormwater drainage from other areas of the Wylder development and the District with the Wylder Parkway Stormwater System. The City does not allow the comingling of City roadway drainage systems with the drainage pipes and structures within privately maintained developments. The District was willing to take over all roadway stormwater maintenance instead of separating the drainage networks.

 

Issues/Analysis: If the City were to take over maintenance of the stormwater for Wylder Parkway allowing the comingling of drainage that has already been installed, without entering into an agreement shifting responsibility for issues, the City will be at risk. Specifically, there is risk of disputes regarding who is responsible for maintenance of the stormwater system or who caused damage or issues relating to the stormwater system.

                     

Financial Information: The execution of this document alleviates concerns regarding commingling of the system and the related financial impacts to the City.

 

Special Consideration: The delay of the execution of this document could allow for additional comingled piping to be installed which will make it more difficult to retrofit and relocate infrastructure if it is determined that this agreement is not acceptable.
