2. Parties: City of Port St. Lucie and Florida Power and Light Company (“FPL”)
3. Purpose: To grant to FPL a 10’ easement for underground power and 15’ around the transformer at the Westport Wastewater Treatment Facility.
4. New/Renewal/Modified: New.
5. Duration: In perpetuity.
6. Benefits to Port St. Lucie: This easement allows FPL to install additional underground facilities and a transformer at the Westport Wastewater Treatment Facility as part of the Nutrient Reduction Improvement Project.
7. Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for the conveyance of this easement.

Staff Recommendation: Move that the Council approve Ordinance 24-73, authorizing the Mayor or her designee to execute the easement for FPL.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Ordinance 24-73, authorizing the Mayor or her designee to execute the easement for FPL.
2. Move that the Council not approve Ordinance 24-73, and provide staff with direction.
Background: The Westport Wastewater Nutrient Reduction Improvement Project will reduce the number of nutrients discharged which may also reduce the growth of algae, improve water quality and reduce health effects of the St. Lucie River. New Florida Department of Environmental Protection nutrient limits required additional treatment processes to achieve limits less than or equal to 10 mg/I TN and 3 mg/I P. The City requests approval to convey an easement to FPL to harden the electrical components and provide electrical redundancy to the wastewater treatment facility. The facilities are located underground other than a transformer.
Issues/Analysis: If the City Council does not approve this conveyance, the City will have to find an alternative power source.
Financial Information: There is no cost to the City for the conveyance of this easement.
Special Consideration: This easement is required by FPL to install and maintain electrical facilities to benefit the Westport Wastewater Treatment Facility.
Location of Project: Westport Wastewater Treatment Facility.
