2. Parties: City of Port St. Lucie and Accurate Septic Services, Inc. (“Accurate”)
3. Purpose: Accurate would provide services should the City’s primary wet lime residual hauler KAG aka Dedicated Transport be unable to provide service.
4. New/Renewal/Modified: New
5. Duration: One-year term, last renewal expires September 30, 2026
6. Benefits to Port St. Lucie: Accurate would be a secondary or back-up to the City’s primary wet lime residual hauler.
7. Cost to Port St. Lucie (Annual and Potential): $11/ton. This service is budgeted at $140,000 for Fiscal Year 2022/2023.

Staff Recommendation: Move that the Council waive bidding per Chapter 35.04(c) for good cause shown and approve participating in the Fort Pierce Utilities Authority (“FPUA”) Contract #22-02 for wet lime residual hauling services.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve participating in the FPUA Contract for wet lime residual hauling services.
2. Move that the Council not approve the City’s participation with FPUA for Contract #22-02 and provide staff with direction.
Background: FPUA competitively procured its wet lime residual hauling services and contracted with Accurate Septic Services, Inc. via ITB 22-02. The City has an existing contract with Dedicated Transport (KAG), however, KAG has indicated that for unforeseen circumstances, through no fault of their own, the Orlando Power Plant can only accept a certain tonnage and may restrict incoming loads. Therefore, the City seeks a temporary alternative or back-up to ensure continuity of service.
Issues/Analysis: This Contract would be a secondary or back-up to KAG. Some weeks, USD’s Prineville Water Treatment Facility (“Prineville”) requires up to 9 loads of wet lime disposal. If KAG were not able to provide the service, Prineville would fall behind on the disposal and could be forced to reduce potable water production from the Lime Softening Plant. The City has no desire to terminate its contract with KAG. The City has prior experience with this vendor and recommends approval.
Financial Information: Funds are appropriated in Account #431-3310-543410.
Special Consideration: This Contract would be a secondary or back-up to the City’s primary wet lime residual hauler. [From Legal: Current vendor’s contract calls for a $200 per day liquidated damages for non-performance; however, the price from this back-up vendor (Accurate) will be $1.00 per ton less than the City’s current contractor charges.]
