Summary Brief (Agreements/Contracts only)

2. Parties: City of Port St. Lucie and Pavement Technology, Inc.
3. Purpose: To allow the City of Port St. Lucie to utilize Pavement Technology, Inc. to provide roadway preservation products and services on City roadways under the conditions of St. Lucie Contract #C20-10-767.
4. New/Renewal/Modified: Modified.
5. Duration: The contract renewal period is October 20, 2022 through October 19, 2023 with the option for two additional one-year periods remaining.
6. Benefits to Port St. Lucie: To extend the useful life of asphalt pavement for a fraction of the cost of resurfacing.
7. Cost to Port St. Lucie (Annual and Potential): Estimated annual expenditure is $500,000.00 based on appropriation in the City budget. Future expenditures shall be appropriated in each budget year.

Staff Recommendation: Move that the Council waive the bidding, per Chapter 35.04 (c), good cause shown, and approve the continued participation of St. Lucie Contract #C20-10-767 as modified under Amendment 1 by St. Lucie County
Alternate Recommendations:
1. Move that the Council not approve participating in St. Lucie County Contract #C20-10-767 as recommended and provide staff with direction.
Background: During FY 15/16 and 16/17 the City utilized a partnership contract with the City of Margate to procure the services of Pavement Technology, Inc. for the application of asphalt rejuvenate to a portion of the City’s roadways. Unfortunately, due to limited funding, the Public Works Department was unable to continue the program in subsequent years. As funding levels increased, the use of asphalt rejuvenate was again programmed into the resurfacing budget and in FY 21/22 the City was able to utilize a partnership contract with St. Lucie County to provide the same services. The existing contract expires in October 2022, and prior to expiration the vendor notified the County of their intent to renew. They have requested an additional $0.26 per square yard for Reclamite Asphalt Rejuvenating Services with a revised unit price of $1.13. The unit price increase is relative to the ever-changing increase in crude oil prices as well as shipping and production costs. The increase only applies to the unit cost for providing and installing the rejuvenating agent and does not affect the current unit pricing for mobilization or maintenance of traffic.
Issues/Analysis: St. Lucie County has approved the contract Amendment to include the increase in unit pricing, and City staff has verified that the unit pricing is in line with the increases being experienced industry wide.
Financial Information: The services to be provided by the vendor are to be funded by the Annual Resurfacing Program (#304-4125-534132).
