Executive Summary (General Business): Mr. Stokes has been serving as the City Attorney since February 22, 2018 when he began as a contract employee with benefits.  Mr. Stokes’s employment  agreement was finalized June 22, 2020 as a permanent employee establishing his terms of employment and rate of pay. At the February 22, 2021 City Council Meeting, City Council requested that staff research past PSL Attorney historical data to determine if car allowances were provided and to research the longevity of the attorneys listed on the salary comparison study.  Council requested that this information be provided at the March 8, 2021 meeting. In addition, at the February 22, 2021 City Council Meeting, Council approved a three percent (3%) salary increase for the City Attorney effective as of May 1, 2021 and to adjust the future annual review date for the City Attorney to May 1st.

Staff Recommendation: Move that the Council discuss the City Attorney’s car allowance and provide an effective date.

Background: Mr. Stokes serves as the City Attorney and his current employment agreement was finalized on June 22, 2020.  While the City Attorney’s employment agreement does not call for an annual review, it is presumed that the Council will want to evaluate the City Attorney and establish a rate increase in a manner similar to the City Manager.  Council may provide Mr. Stokes with a written performance evaluation, but it is not required. It is important to note the PSL City Attorney salary in comparison to others and that the position is not included on the City’s pay plan, so there is no minimum or maximum rate established for this position. At the February 22nd, 2021 City Council Meeting, Council approved a three percent (3%) salary increase for the City Attorney effective as of May 1 2021 and to adjust the future annual review date for the City Attorney to May 1.
