Staff Recommendation: Move that the Board approve Affordable Housing Advisory Committee Incentive recommendations and decide on a public hearing date.

Alternate Recommendations:

1.                     Move that the Board provide new/additional recommendations for Affordable Housing Advisory Committee Incentives and decide on a public hearing date.

2.                     Move that the Board not approve the existing incentives and provide staff direction.

Background: The following is a summary of incentives as directed by Florida State Statutes. An overview of these incentives and recent actions taken by past AHACs will be presented by staff as a review. The Committee can discuss and finalize at the meeting on October 19th, 2024.

1. Expedited permitting: The processing of approvals of development orders or permits for affordable housing projects is expedited to a greater degree than other projects.

 2. The allowance of flexibility in densities:  To undertake efforts to amend Ordinance 23 to reduce the minimum square footage requirement for affordable housing.

3. The reservation of infrastructure capacity: Reducing or eliminating the cost of land decreases the cost of developing affordable housing.

4. The allowance of affordable accessory residential units:

An ADU is “an ancillary or secondary living unit, that has a separate kitchen, bathroom, and sleeping area, existing either within the same structure, or on the same lot, as the primary dwelling unit.” F.S. 163.31771

The Florida Legislature recognizes ADUs as a “tool to help local communities address deficits in the supply of affordable rental housing for very-low-, low-, and moderate-income residents.”

5. The allowance of flexible lot configurations: To undertake efforts to amend minimum lot requirements from Ordnance 23.

6. Modification of street requirements: The modification of street requirements can reduce development costs and allow more land to be developed as housing. Modifications may free up land for lots and may allow for more flexible design.

7. The reduction of parking and setback requirements: Some housing may benefit from a reduction in the required number of parking spaces required by the land use code. Flexibility in these requirements can help lower development costs and ensure that more of buildable land is available for housing development.

8. Local Government Review Process:

The establishment of a process by which a local government considers, before adoption, policies, procedures, ordinances, regulations, or plan provisions that increase the cost of housing.

9. The support of development near transportation hubs:

Build housing close to bus stops, including, but not limited to the Port St. Lucie Intermodal Facility.

10. Modification of impact fee requirements:

Fees to consider for waiver or reduction: Impact fees, permitting fees, inspection fees, site plan review, re-zoning or other hearing fees, engineering fees.

11. Public land inventory:

The preparation of a printed inventory of locally owned public lands suitable for affordable housing.

The reduction or elimination of land costs leads to a decrease in the overall expenditure associated with the development of affordable housing.

Statutory Requirement since 2007: Create a Surplus Land Inventory for affordable housing. Statutes 125.379 and 166.0451 (2020)

Issues/Analysis: None expected.
