Executive Summary (General Business): At the March regular Planning and Zoning Board meeting, the board recommended to the City Council to remove board member Ana Gomez-Mallada, District 3 Board member due to absenteeism.

 

Presentation Information: n/a

 

Staff Recommendation: Move that the Council remove Ana Gomez-Mallada as a District 3 Planning and Zoning Board Member and request for staff to proceed with soliciting a replacement.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and proceed with soliciting applicants for the Planning and Zoning Board.

2.                     Move that the Council reject the Planning and Zoning Board’s recommendation.

 

Background: The Planning and Zoning Board provides recommendations to the City Council.  The Planning and Zoning Board by-laws provides some guidance on attendance and absenteeism.  Ms. Gomez-Mallada for the past four Planning and Zoning Board meetings has been participating via Zoom however; she has not been able to vote on some agenda items due to her absenteeism during the roll call.

 

Issues/Analysis: Pursuant to section 12.03 of the City Charter the City Council has authority to to remove Planning and Zoning Board members.  The provision in the charter states:

 

Any member of the Planning and Zoning Board may be removed by a vote of the City Council either with or without cause.

Special Consideration: City staff is currently processing a City initiated amendment to the Code of Ordinances to change the constitution of the Planning and Zoning Board to allow for all members of the board to be “at large members.”  This item is scheduled to be heard by the City Council at the first regular meeting in April.
