Summary Brief (Agreements/Contracts only)

2.                     Parties: City of Port St. Lucie and SoCal Shaker Plates & Construction Site Services, LLC d/b/a National General Construction (“Contractor”).

3.                     Purpose: To award a contract for the development of O.L. Peacock, Sr., Park, providing new recreational amenities that support the City’s Strategic Plan and enhance community quality of life.

4.                     New/Renewal/Modified: New.

5.                     Duration:  two-hundred and seventy-three (273) calendar days.

6.                     Benefits to Port St. Lucie: The O.L. Peacock, Sr. Park project supports the City’s Strategic Plan by expanding access to quality recreational amenities in a growing area. The new playground, walking trail, pavilions, landscaping, and parking will enhance community life and promote active, healthy lifestyles.

7.                     Cost to Port St. Lucie (Annual and Potential):  The successful bid amount is $1,973,971.59, plus a 5% contingency of $98,698.58, for a total estimated expenditure of $2,072,670.17.

2.                     Move that the Council reject all bids and provide staff with direction to rebid or cancel the bid.

 

Background: O.L. Peacock, Sr., Park development is a key initiative under the City’s Strategic Plan, Goal 6: Culture, Nature, and Recreation, and was designated a Priority Project with funding allocated in the City’s Capital Improvement Plan. The park is currently a neighborhood facility featuring a lake with fishing and kayak access. The scope of the upcoming development includes the construction of a paved walking trail, a new playground, and two shade pavilions. In March 2021, the Parks & Recreation Department (PSLPRD), in partnership with the Neighborhood Services Department, contracted with Culpepper & Terpening, Inc. to create a conceptual master plan based on public and stakeholder input. City Council approved the final concepts and phasing plan in June 2022. In August 2022, PSLPRD submitted a successful Florida Recreation Development Assistance Program (FRDAP) grant application, securing a $200,000 award in August 2023. A Notice to Commence was issued on September 19, 2024, and design services were completed by Captec Engineering. With planning and design now finalized, the project is ready to advance into construction through award of this Contract.

E-bid #20250180 was issued on July 30, 2025, to 41 potential suppliers, with 16 plan holders and 7 proposals received by September 9, 2025. One proposal was deemed non-responsive for missing required documentation, leaving six responsive bids ranging from $1,679,411.97 to $2,299,744.31. West Construction, Inc. (“West Construction”) submitted the lowest bid at $1,679,411.97, followed by Contractor at $1,973,971.59.

West Construction served as the City’s contractor for the Winterlakes Neighborhood Park Phase I Construction project in 2021, where it received poor evaluation scores in eight-of-twelve categories, including in critical areas, such as delivery times, reliability, responsiveness to issues, adherence to schedule, adequacy of staffing, subcontractor management, timely project closeout and punch list completion, and overall performance. In addition to the City’s experience through the Winterlakes project, staff contacted West Construction’s references. While some references were unavailable, feedback from several municipalities highlighted recurring issues related to delays, change orders, subcontractor oversight, and communication. Based on these documented performance considerations and cautionary external references, staff recommends awarding Contract #20250180 to Contractor.

 

Issues/Analysis: Staff has reviewed the proposals with all the bid documents and determined that Contractor is the most responsible, responsive bidder and will provide the best value to the City of Port St. Lucie. Per City Code of Ordinances, Section 35.12, the City has sole and absolute discretion to determine best value, by considering the enumerated list of factors. Based on the explanation above, staff believes that and SoCal Shaker Plates & Construction Site Services, LLC provides the best value considering the factors in Section 35.12(a), and most particularly: Section 35.12(a)(1) (“Skill, workmanship, experience, and past performance demonstrated by the bidder or proposer in performing the same type of work or services as those sought by the City, or the experience, expertise and quality of services demonstrated by the bidder or proposer for professional, consulting or other services.”).
