2. Parties: City of Port St. Lucie and the U.S. Department of the Treasury
3. Purpose: The City of Port St. Lucie is scheduled to receive $24,739,425 from the U.S. Department of the Treasury through its direct allocation from the Coronavirus Local Fiscal Recovery Fund. The City will receive these funds in two tranches with 50% of the funds or $12,369,712.50 received on June 4, 2021. The second tranche will be distributed 12 months later.

5. Duration: The period of performance for award began on June 4, 2021 and will end on December 31, 2026. As set forth in Treasury’s implementing regulations, Recipients may use award funds to cover eligible costs incurred during the period that began on March 3, 2021 and ends on December 31, 2024.
6. Benefits to Port St. Lucie: This funding benefits Port St. Lucie residents in the recovery from the coronavirus pandemic and improves critical water, sewer and broadband infrastructure.
7. Cost to Port St. Lucie (Annual and Potential): Any annual and/or potential additional costs to Port St. Lucie are being identified as projects are developed and bid in compliance with federal guidelines.

Staff Recommendation: Move that the Council 1.) authorize the City Manager or designee to accept Coronavirus Local Fiscal Recovery Fund and award terms and conditions between the City of Port St. Lucie and the U.S. Department of the Treasury effective June 4, 2021; 2.) accept the funds effective June 4, 2021; and 3.) allocate the funds per the updated listing of projects previously reviewed by Council (Per the Resolution and Exhibit A).
Alternate Recommendations:
1. Move that the Council amend the recommendation and 1.) authorize the City Manager or designee to accept Coronavirus Local Fiscal Recovery Fund and award terms and conditions between the City of Port St. Lucie and the U.S. Department of the Treasury effective June 4, 2021; 2.) accept the funds effective June 4, 2021; and 3.) allocate the funds per the updated listing of projects previously reviewed by Council (Per the Resolution and Exhibit A).
2. Move that the Council provide staff direction.
Background: The American Rescue Plan Act of 2021 was signed into law on March 11, 2021. The $1.9 trillion package is intended to combat the COVID-19 pandemic, including the public health and economic impacts. On May 10, 2021 the U.S. Department of the Treasury announced the launch of the Coronavirus State and Local Fiscal Recovery Funds, established by the American Rescue Plan Act of 2021, to provide $350 billion in emergency funding for state, local, territorial, and Tribal governments. Treasury also released guidelines detailing how funds can be used to respond to acute pandemic-response needs, fill revenue shortfalls among state and local governments, and support the communities and populations hardest-hit by the COVID-19 crisis. The City of Port St. Lucie received funding direct from the Treasury Department and was allocated $24,739,425. The State and Local Coronavirus Fiscal Recovery Funds will be disbursed in two funding cycles. The first cycle is 50% of the total funding and directly provided to the recipients no later than 60 days after enactment, or before May 10, 2021. The City of Port St. Lucie received $12.369 million on June 14, 2021. The second cycle will be the remainder of the funds and directly provided, no earlier than 12 months after receipt of the first payment. The deadline to spend all funds is December 23, 2024.
Issues/Analysis: The City Council has previously provided direction on recommended allocations. The project list has been updated to reflect the most recently input of staff and interpretation of the Interim Final Rule governing the use of these funds.
Financial Information: Funds are being accepted in conjunction with the budget amendment ordinance.
Special Consideration: The period of performance for award began on June 4, 2021 and will end on December 31, 2026. As set forth in Treasury’s implementing regulations, the City may use award funds to cover eligible costs incurred during the period that began on March 3, 2021 and ends on December 31, 2024.
