Staff Recommendation: Move that the Council approve the surplus designation of the Subject Property and approve disposing of the Subject Property by utilizing the City’s real estate broker.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the surplus designation of the Subject Property and approve disposing of the Subject Property by utilizing the City’s real estate broker.

2.                     Move that the Council not approve  the surplus designation of the Subject Property and disposing of the Subject Property by utilizing the City’s real estate broker and provide direction.

 

Background: In 2001, the developers of Midway Business Park conveyed 60 acres of real property to the City in exchange for infrastructure improvements for the industrial park. The City designated the land for economic development and conveyed property to businesses that would create jobs and make a capital investment in the real property. The properties conveyed included a reverter clause, so if the company did not fulfill its development and job requirements, the property would revert back to the City. The Subject Property was deeded back to the City in 2011 when Phoenix Metals cancelled its expansion in the Midway Business Park.

 

Issues/Analysis: Following the requirements that are established in City Policy #18-01ccd, all City Departments verified that they had no use for the Subject Property. City Policy #18-01ccd provides for the two methods of disposal of surplus real property, auction or RFP. The policy further provides the City Council with the right to dispose of surplus real property by any other means in the best interest of the City, upon motion by the City Council. It is staff’s recommendation that it is in the best interest of the City to dispose of the Subject Property by utilizing the Real Estate Broker currently under contract with the City as this method will likely realize the most proceeds. All methods require an appraisal to establish the minimum price for the sale and that all adjacent property owners within 300’ of the property to be sold be notified of the sale by first class mail. All sales, regardless of the method used, must be finalized by an Ordinance in accordance with the terms and provisions of the City Charter Section 9.09(g). City Policy #18-01ccd.

                     

Financial Information: A one-time revenue to the City and a potential increase to the tax roll.

 

Special Consideration: The St Lucie Economic Development Council (EDC) is actively marketing Midway Business Park and recently announced the expansion of Total Truck Parts and Jan Steel. The City’s Broker, Collier’s International, in conjunction with the EDC will assist the City in selling the Subject Property to an end user that will create jobs and make a capital investment in real property and equipment.
