2. Parties: City of Port St. Lucie and Zahlene Enterprises, Inc.
3. Purpose: To provide for the installation of a deadman thrust block as requested by the Utility Systems Department.
4. New/Renewal/Modified: Modified.
5. Duration: An additional 58 days were added in Amendment #6, 37 days were added in Amendment #7, 450 days were added in Amendment #8, 43 days were added in Amendment #9, 108 days were added in Amendment #10, and 4 days are needed for Amendment #11. The new end date is June 6, 2025.
6. Benefits to Port St. Lucie: This project will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, underground drainage, and upgraded water and sanitary facilities.
7. Cost to Port St. Lucie (Annual and Potential): An additional $0.00 for Amendment #6, $14,191.47 for Amendment #7, $155,399.25 for Amendment #8, $0.00 for Amendment #9, $0.00 for Amendment #10, and $36,877.37 for Amendment #11. The total amount of the contract is $8,258,642.54.

Staff Recommendation: Move that the Council ratify Amendments #6 through #10 and approve Amendment #11 to Contract #20200077 for the Construction of Port St. Lucie Blvd. North Roadway Project with Zahlene Enterprises, Inc.
Alternate Recommendations:
1. Move that the Council amend the recommendation and ratify Amendments #6 through #10 and approve Amendment #11 to Contract #20200077.
2. Move that the Council not ratify Amendments #6 through #10 nor approve Amendment #11 and provide staff with direction.
Background: Amendment #6 was for 58 additional days needed to place bedding stone and rip rap ditch lining in additional areas beyond the original scope.
Amendment #7 was needed to relocate the existing traffic signal cable at Aurelia Avenue and Port St. Lucie Blvd. due to a conflict that was discovered during the new drainage pipe installation. This resulted in an additional 37 days and $14,191.47.
Amendment #8 was needed for additional days to allow for procurement delays, various other delays, exploratory work for unforeseen utilities, exploratory work to add structures due to constructability issues, weather days and holidays. This resulted in a total of 450 days and $155,399.25.
Amendment #9 was needed for 43 additional days due to damaged fiber optic cable and the Contractor not being able to perform earthwork grading activities in the area surrounding the damage. No additional funds were required.
Amendment #10 was needed for 108 additional days to account for delays due to work stoppage by the Utility Systems Department, weather days and holidays.
Amendment #11 is needed to provide for the installation a thrust block for the 16-inch main with 48 inches of cover installed on this project in lieu of installing restraints. Doing so will provide more space between the line stop and the connection for the thrust block installation. This resulted in 4 days and $36,877.37
Issues/Analysis: Council approved Amendment #5 on May 8, 2023. Since then, the amount of the Contract Amendments have remained under City Council threshold pursuant to City Code of Ordinances, Section 35.09(b), and its predecessor ordinance, until Amendment #11. Since Amendment #11 requires City Council approval under Section 35.09(b), staff is requesting Council ratify Amendments #6-10 and approve Amendment #11. Staff has reviewed the Amendments and finds them to be fair and reasonable.
Financial Information: Funds are appropriated in the Road & Bridge CIP / Traffic / Improvements O/T Building / SW PSL Blvd. Reconstruction (#301-4121-563000-Y1717).
