2.                     Parties: City of Port St. Lucie , Mattamy Palm Beach, LLC (Mattamy) and the Port St. Lucie Governmental Finance Corporation (GFC)

3.                     Purpose: Enter into an agreement that establishes when traffic signals will be installed along the Village Parkway and Becker Road corridors within the Southern Grove Development area.

4.                     New/Renewal/Modified: New

5.                     Duration: Perpetual until final requirements of FDOT specifications are met.

6.                     Benefits to Port St. Lucie: Establishing when needed traffic signals will be installed along the Village Parkway and Becker Road corridors within the Southern Grove Development area.

7.                     Cost to Port St. Lucie (Annual and Potential): None, as all costs are borne by Mattamy and the GFC.

Background: During the June 13, 2022 City Council meeting, with Resolution 22-R70, Mattamy requested relief from a previous Council Condition of Approval for the Telaro Development. City Council granted the requested relief and imposed the following Council Condition of Approval: (1) Mattamy Homes Palm Beach, LLC shall draft and enter into and agreement that identifies (i) when traffic signals are needed for any connections to the Village Parkway and Becker Road corridors within the Southern Grove DRI boundaries and (ii) the mutually agreed upon proportionate financial obligation for relevant parties’ for each traffic signal within the Southern Grove Boundary along the Village Parkway and Becker Road corridors; such agreement must be in a form approved by the City (the “Traffic Signal Agreement”). (2) The Traffic Signal Agreement shall be approved and fully executed within 270-days of Council Approval of this Resolution during which time permits for Phase 3 may be issued. (3) If the Traffic Signal Agreement is not executed and approved within the 270-day timeframe, no additional permits will be issued for any portion of the Telaro Development.

 

As such, City staff along with Mattamy and GFC staff have come to terms with the attached agreement and desire to fully execute it.

 

Issues/Analysis: The City will receive assurances that necessary traffic signals along the Village Parkway and Becker Road corridors within the Southern Grove Development area will be installed. Additionally, should the City not approve and execute this agreement Mattamy will no longer obtain permits for their Telaro Development after March 10, 2023.

                     

Financial Information: All costs for the design and construction of the traffic signals will be the responsibility of Mattamy and the GFC.
