Executive Summary (General Business): AJ Entitlements & Planning has submitted a request to abandon Flowage Easements for development of Vitas P21-003, Thompson Thrift P20-057, and Baron Shops P20-004.

 

Presentation Information: N/A

 

Staff Recommendation: Move that the Council approve the ordinance to abandon the Flowage Easements.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the ordinance to abandon the Flowage Easements.

2.                     Move that the Council not approve the abandonment and provide staff direction.

 

Background:  With the development of adjacent parcels, the Community Boulevard drainage has since been directed into Water Management Tract No. 1 of Southern Grove Plat No. 18 and no longer drains through Parcels 1 and 2 of Southern Grove Plat No. 31. Abandonment of the Flowage Easements is necessary for development of Parcels 1 and 2. The owners of the property have submitted a request for the abandonment of the Flowage Easements to the City.

 

Issues/Analysis: The Public Works Department has reviewed the request to abandon the Flowage Easements and has no objections.

                     

Financial Information: There will be no cost incurred by the City.

 

Special Consideration: Abandonment of the Flowage Easement is necessary for development of Parcels 1 and 2 of Southern Grove Plat No. 31.

 

Location of Project: The project is located on the southeast corner of Community Boulevard and Tradition Parkway.
