6.                     Benefits to Port St. Lucie: This amendment to the Locally Funded Agreement (LFA) allows the City to provide the required additional funding to FDOT, per the terms of the original LFA. The total Project cost is estimated to be Three Million Six Hundred Eighty-Six Thousand Six Hundred Forty-Five Dollars and no cents ($3,686,645.00). Per the conditions of the original LFA, in the event the actual cost of the project is greater than that paid by the City, the City shall be responsible to pay the difference to the FDOT. On September 19, 2019, FDOT received Seven Hundred Ninety-One Thousand Eight Hundred Fifty-Two Dollars and no cents ($791,852.00) from the City for the Project’s design services. The actual Project design cost is Nine Hundred Forty-Three Thousand One Hundred Ninety-One Dollars and no cents ($943,191.00); therefore, the City is responsible for the difference of One Hundred Fifty-One Thousand Three Hundred Thirty-Nine Dollars and no cents ($151,339.00).

7.                     Cost to Port St. Lucie (Annual and Potential): The City’s cost is One Hundred Fifty-One Thousand Three Hundred Thirty-Nine Dollars and no cents $151,339.00.

Staff Recommendation: Move that the Council approve the resolution for the Locally Funded Agreement Amendment Number One.

Background: The St. Lucie County Transportation Planning Organization (TPO) has designated federal funding from the Federal Highway Administration for the design, permitting, acquisition of property rights, and construction of public improvements on Port St. Lucie Boulevard from South of Paar Drive to South of Darwin Boulevard. In accordance with Florida Statutes and Federal funding provisions, FDOT is authorized to manage the federally funded project on behalf of the City.  The project improvements include widening the road from two to four lanes including sidewalks, lighting, drainage, traffic signals, and landscaping.  On August 28, 2019, the State of Florida Department of Transportation (FDOT) and the City of Port St. Lucie entered into a Locally Funded Agreement to provide FDOT financial assistance for the design services in connection with the project. On September 19, 2019, FDOT received the City’s financial contribution of Seven Hundred Ninety-One Thousand Eight Hundred Fifty-Two Dollars and no cents ($791,852.00), as required by the LFA. The project required design revisions adjusting the roadway profile to accommodate thirty-five (35) newly constructed driveways along the project corridor, resulting in additional design and project costs. The City’s share for the design services has increased; therefore, the City is required to pay the additional amount of One Hundred Fifty-One Thousand Three Hundred Thirty-Nine Dollars and no cents ($151,339.00). The roadway construction is in FDOT’s FY 2024-2028 5-year work program and is being scheduled for Letting this year (2025).

 

Issues/Analysis: Per the terms of this Amendment, the City must furnish FDOT with a check or a wire transfer in the amount of One Hundred Fifty-One Thousand Three Hundred Thirty-Nine Dollars and no cents ($151,339.00), within thirty (30) days of executing the Amendment.  In the event payment is not received by FDOT within thirty (30) of execution of the Amendment, FDOT reserves the right to suspend the project’s design services until the additional funding is received.

                     

Financial Information: The estimated total design cost is Three Million Six Hundred Eighty-Six Thousand Six Hundred Forty-Five Dollars and no cents ($3,686,645.00). Under the LFA, the City is responsible for Nine Hundred Forty-Three Thousand One Hundred Ninety-One Dollars and no cents ($943,191.00). The City made a previous payment of Seven Hundred Ninety-One Thousand Eight Hundred Fifty-Two Dollars and no cents ($791,852.00) on September 19, 2019. The additional amount due to FDOT is One Hundred Fifty-one Thousand Three Hundred Thirty-Nine Dollars and no cents ($151,339.00).

 

Special Consideration: The Amendment is required so that the City can provide FDOT with the additional funds for design services in connection with the reconstruction of Port St. Lucie Boulevard from South of Paar Drive to South of Darwin Boulevard.
