2. Parties: City of Port St. Lucie and Operational Technical Services, LLC.
3. Purpose: The Utility Systems Department ("USD") is seeking approval of a sole source contract to employ contractual professionals who are licensed in technical disciplines, such as water and wastewater plant operators and electricians, during periods of position vacancies.
4. New/Renewal/Modified: New.
5. Duration: One (1) year with the option to renew for two (2) additional one (1) year periods.
6. Benefits to Port St. Lucie: The Utility Systems Department is mandated by the Florida Department of Environmental Protection (FDEP) to maintain a specified number of water/wastewater operators at their designated plant. This contract will enable the use of contractual staffing to fill vacancies and ensure compliance with Florida Administrative Code (FAC) Chapter 62-699 until a full-time employee can be hired.
7. Cost to Port St. Lucie (Annual and Potential): Estimated expenditures between $700,000-$1,000,000 annually. However, the contract employee would temporarily fill the place of an FTE. The cost savings from the FTE would be allocated to support the funding of the contract employee.

Staff Recommendation: Move that the Council waive the bidding process, per City Code Section 35.08(d), and approve the contract with Operational Technical Services, LLC as the Sole Source Provider for Temporary Technical Staffing Services.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve contract #20240149 with Operational Technical Services, LLC.
2. Move that the Council not approve contract #20240149 with Operational Technical Services, LLC. and provide staff direction.
Background: The USD has FTE positions that require specialized technical licenses, which are not easily obtained. As a result, it can take several months or even years to fill these technical positions due to the limited number of qualified applicants.
Issues/Analysis: Staff has reviewed the current price list and finds it acceptable. USD recommends the approval of the new contract as this company is the sole provider of these services in Florida.
