Staff Recommendation: Move that the Council approve the Ordinance for the Property Exchange and Development Agreement.

2. Move that the Council not approve the Ordinance and provide staff direction.
Background: James J. McGlone, Jr. (Developer) executed and recorded a plat entitled “Cumberland Farms at Darwin and Port St. Lucie” on March 23, 2016. The plat created Tract “C” to provide access and facilitate the extension of SW Darwin Boulevard from SW Port St. Lucie Boulevard to SW Briggs Street. The City and the Developer desire to enter into an agreement whereby the Developer will not only convey and dedicate said right of way to the City but also construct the proposed extension of SW Darwin Boulevard from SW Port St. Lucie Boulevard to SW Briggs Street at its expense in exchange for the conveyance of SW Bianca Avenue right-of-way, located between SW Port St. Lucie Boulevard and SW Briggs Street, to the Developer.
The roadway and drainage infrastructure of the SW Darwin Boulevard extension on “Cumberland Farms at Darwin and Port St. Lucie” Tract “C” was constructed by the Developer and the pavement on SW Bianca Avenue has since been removed and the roadway closed.
Issues/Analysis: Execution of the Property Exchange and Development Agreement between the City and James J. McGlone, Jr. is necessary to complete the conveyance of the Bianca Avenue right-of-way, between SW Port St. Lucie Boulevard and SW Briggs Street, to James J. McGlone, Jr.
Financial Information: None
Special Consideration: The Developer is required to reserve an easement to the City for access and maintenance of an existing water and low-pressure sewer main on the portion of SW Bianca Ave that will be conveyed to the Developer. The reservations to the City are included in the Quit Claim Deed that will be executed by the City to James J. McGlone, Jr.
Location of Project: West of Port St. Lucie Boulevard and north of Cumberland Farms at Darwin Boulevard.
