Summary Brief (Agreements/Contracts only)

2. Parties: City of Port St. Lucie and Johnson, Mirmiran & Thompson, Inc. (“JMT”).
3. Purpose: To provide an increase in funding and time for the CEI & GEO Services to align contract funding & time with the anticipated total contract time for the construction.
4. New/Renewal/Modified: Modified.
5. Duration: An additional 49 calendar days for a new end date of September 18, 2025.
6. Benefits to Port St. Lucie: The Port St. Lucie Blvd. Segment 3 Project will provide additional intersection capacity, accessible multi-use pathways, pedestrian lighting, underground drainage, and upgraded water and sanitary facilities.
7. Cost to Port St. Lucie (Annual and Potential): An additional $170,736.00 for a new Contract amount of $1,539,485.00.

Staff Recommendation: Move that the Council ratify Amendment #5 and approve Amendment #6 to Contract #20230117 for the CEI & GEO Services for the Port St. Lucie Blvd. Segment 3 Project with Johnson, Mirmiran & Thompson, Inc.
Alternate Recommendations:
1. Move that the Council amend the recommendation and ratify Amendment #5 and approve Amendment #6 to Contract #20230117.
2. Move that the Council not ratify Amendment #5 nor approve Amendment #6 to Contract #20230117 and provide staff with direction.
Background: On September 12, 2023, the City of Port St. Lucie executed a contract with JMT for CEI & GEO Services for the above referenced project. The contract commenced on September 12, 2023, and originally terminated 200 calendar days thereafter on March 30, 2024. The original contract amount was $659,656.00.
• Amendment #1 was executed on March 5, 2024, which extended the contract term only through August 31, 2024.
• Amendment #2 was executed on June 25, 2024, which increased the contract value by $442,564.50 and extended the contract time through December 9, 2024.
• Amendment #3 was executed on December 19, 2024, which extended the contract time only through May 2, 2025.
• Amendment #4 was executed on January 13,2025, which increased the contract value by $266,528.50.
• Amendment #5 was executed on April 28, 2025, which extended the contract time only through July 31, 2025.
• Amendment #6 provides for a conservative estimate for the project’s construction to be completed by July 31, 2025, with the CEI & GEO Services completing 49 days thereafter on September 18, 2025. This results in an additional 49 days and an additional $170,736.00 required for project close-out.
Issues/Analysis: Council most recently approved Amendment #4, and Amendment #5 was for time only, which did not require Council approval pursuant to City Code of Ordinances, Section 35.09. Since Amendment #6 requires Council approval under Section 35.09(b), staff is requesting Council ratify Amendment #5 and approve Amendment #6. Staff has reviewed the Amendment and find it to be fair and reasonable.
Financial Information: Funds are appropriated in Road & Bridge CIP Fund / Traffic / Improvements O/T Building / SW PSL Blvd. Reconstruction (#304-4121-563000-Y1717).
Special Consideration: The Florida Department of Transportation (FDOT) has provided concurrence for this Amendment.
Location of Project: SW Port St. Lucie Blvd. west of Gatlin Blvd.
