Summary Brief (Agreements/Contracts only)

2. Parties: City of Port St. Lucie and Riverland Community Association, Inc.
3. Purpose: To authorize the Riverland Community Association, Inc., to assume certain maintenance responsibilities for portions of Community Blvd, Discovery Way, Riverland Blvd, and Marshall Parkway.
4. New/Renewal/Modified: New
5. Duration: Perpetual duration until either party provides a 120 day notice to terminate.
6. Benefits to Port St. Lucie: The agreement will allow the Riverland Community Association, Inc., to maintain the landscaping within the various rights-of-way above the minimum standard that the City would typically maintain.
7. Cost to Port St. Lucie (Annual and Potential): There will be no cost to the City.

Staff Recommendation: Move that the Council approve the resolution authorizing the Mayor to enter into a maintenance agreement between the Riverland Community Association, Inc., and the City of Port St. Lucie for the roadways listed in the Southwest Annexation area.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the resolution.
2. Move that the Council not approve the resolution and provide staff direction.
Background: According to the Development of Regional Impact for the Riverland Community, roadways are obligated to be constructed by the developer and turned over to the City for ownership and maintenance. The developer has the ability to install landscaping, hardscape, and non-regulatory signage that is above and beyond the minimum requirements of the City. When this occurs, the developer also tends to desire a higher level of maintenance than the City typically funds. This agreement will remove the responsibility of the City to maintain and put the maintenance of the landscaping, decorative hardscape, and non-regulatory signage on the Riverland Community Association, Inc. The list of roadways included in the agreement are the portions of roadway that Riverland has either already constructed and turned over to the City, with the exception of Becker Rd., or portions that are already under construction by the Riverland developer. It is staff’s understanding that when development occurs adjacent to Becker Rd. within Riverland that the Association intends to amend this agreement to include Becker Rd. at that time.
Issues/Analysis: This resolution authorizes the Mayor to enter into the maintenance agreement between the Riverland Community Association, Inc., and the City. The agreement designates and sets forth the responsibilities of the Association regarding the landscaping, decorative hardscape, and non-regulatory signage.
Financial Information: The Riverland Community Association shall be responsible for the routine maintenance within the designated roadways. There will be no direct cost to the City.
Special Consideration: Execution of the maintenance agreement is necessary for the Riverland Community Association to assume the responsibilities of landscape, hardscape, and non-regulatory signage maintenance within multiple portions of the City’s Southwest Annexation area rights-of-way.
Location of Project: Community Blvd. from Discovery Way to Marshall Parkway, Discovery Way from Community Blvd to west entrance on Parcel C, Riverland Blvd from Discovery Way to Marshall Parkway and Marshall Parkway from Community Blvd west to just past the commercial parcel.
