Executive Summary (General Business): The City Hall Police Building expansion requires the abandonment of a portion of the Best Street, a Sixty (60) foot wide road right-of-way, in order to create one unified site.

Staff Recommendation: Move that the Council approve the Ordinance abandoning a portion of Best Street, a Sixty (60) foot wide road right-of-way.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve the Ordinance abandoning a portion of Best Street.
2. Move that the Council not approve the abandonment and provide staff direction.
Background: Best Street is a platted road right-of-way lying in Port St. Lucie Section Eighteen, as recorded in Plat Book 13, pages 17 through 17K, of the Public Records of St. Lucie County. A portion of the road right-of-way bisects the City Hall Complex. The City desires to construct an expansion of the City’s Police Department building and needs to create one unified site plan for the City Hall Complex. The abandoned portion of right-of-way will be incorporated into the City Hall site plan. It should be noted that the physical abandonment of Best Street is already complete with the addition of Building B and the associated parking lots in 2004/2005; and this right-of-way abandonment and easement is correcting an issue that should have been done with the Building B expansion
Issues/Analysis: The request to abandon a portion of the road right-of-way was evaluated by the Public Works Department, Utility Systems Department, and the Public Utility Companies (AT&T, FPL, Comcast, and Florida City Gas). AT&T has identified facilities on both sides of SW Best Street within the proposed ROW abandonment and has requested that the City provide either an easement over the existing facilities or payment to relocate said facilities. Staff is preparing an easement in favor or AT&T for its existing facilities, which is provided under a separate vehicle. The City Departments and Utility Companies (other than AT&T) have no objection to the abandonment of the sixty (60) foot wide road right-of-way.
Financial Information: There will be no cost incurred by the City.
Special Consideration: A Utility Easement will be granted in favor of AT&T for the company’s facilities that are currently located with the abandoned ROW area. It should also be considered that should the City not grant the associated easement the City would be responsible for the costs associated to relocate the AT&T facilities.
