Executive Summary (General Business): The State of Florida has an action pending and several cities, including the City of Port St. Lucie, is a participating litigant against the companies and distributors for their involvement in the opioid epidemic.
Presentation Information: A presentation will be provided by Outside Counsel representing the City of Port St. Lucie in the Opioid Litigation.
Staff Recommendation: Move that the Council authorize the City to join in the statewide Memorandum of Understanding to settle certain opioid litigation.
Alternate Recommendations:
1. Move that the Council approve the Memorandum of Understanding only under amended terms.
2. Move that the Council not approve and provide staff with direction.
Background: The State of Florida and lawyers representing certain various local governments involved in the Opioid Litigation have proposed a unified plan for the allocation and use of prospective settlement dollars from opioid related litigation.
Issues/Analysis: The Florida Memorandum of Understanding (the “Florida Plan”) sets forth sets forth a framework of a unified plan for the proposed allocation and use of opioid settlement proceeds and it is anticipated that formal agreements implementing the Florida Plan will be entered into at a future date.

Special Consideration: The Council must authorize the Vice Mayor to execute the Resolution approving the Proposal Memorandum of Understanding to move forward in the litigation regarding the opioid epidemic settlement with Johnson & Johnson and Purdue.
