body

Submitted By: Kevin R. Matyjaszek, Utility Systems Director.

Strategic Plan Link: The City's Goal of a high-performing city government organization.

Summary Brief (Agreements/Contracts only)

1.                     Prepared by: Utility Systems Department (USD).

2.                     Parties: City of Port St. Lucie and Jacob Concannon (Lessee)

3.                     Purpose: To allow the City to enter into a cattle grazing lease with Jacob Concannon on a portion of the property known as the Glades Wastewater Treatment Facility (Glades WWTF).

4.                     New/Renewal/Modified: New, however, the City has leased this property to Jacob Concannon previously.

5.                     Duration: Five-year terms.

6.                     Benefits to Port St. Lucie: The Lease allows Lessee to graze cattle which effectively maintains approximately 400 acres of the unoccupied areas of the Glades WWTF.

7.                     Cost to Port St. Lucie (Annual and Potential): There is no cost to the City for this Lease.

Presentation Information: N/A.

Staff Recommendation: Move that the Council approve the Ordinance authorizing the City Manager or the Mayor of the City of Port St. Lucie to execute the Lease Agreement with Jacob Concannon.

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Ordinance authorizing the City Manager or the Mayor of the City of Port St. Lucie to execute the Lease Agreement with Jacob Concannon.

2.                     Move that the Council not approve the Ordinance and provide staff with direction.

Background: The City and Lessee entered into a Cattle Grazing Lease Agreement via Ordinance 13-36 based on the same terms and premises herein. That Lease Agreement expired in 2023.

Issues/Analysis: The Cattle Grazing Lease Agreement with Jacob Concannon allows cattle grazing on the real property for the purpose of reducing the expenditure of City funds to mow and maintain portions of the real property located at the Glades Wastewater Treatment Facility.

Financial Information: There is no cost to the City for this Lease. Cattle grazing reduces the USD’s expenditure of mowing and maintaining the acreage covered by the Lease Agreement.

Special Consideration: In exchange for using the leased property to graze cattle, the Lessee shall keep and maintain the grass at a height not to exceed three feet and shall keep the grounds in an attractive condition during the Lease term. The Lessee is responsible for the payment of all taxes and any other charges levied against the property during the lease term. The Lessee had previously constructed a fence. The Lease area has not changed since the 2013 Lease Agreement.

Location of Project: 10700 Glades Cut-Off Road, Port St. Lucie, Florida, and known as the Glades Wastewater Treatment Facility.
