3. Purpose: To amend the Contract to extend the duration and include Grant Administration Services for the (continued) intent to complete this project.
4. New/Renewal/Modified: Modified.
5. Duration: This Amendment grants additional time through December 2027.
6. Benefits to Port St. Lucie: The Westport Wastewater Treatment Facility (“WWTF”) is permitted to treat up to 6.00 million gallons per day (“MGD”). This Project will alleviate flow which would normally go to the Westport WWTF to the Glades Booster Pump Station instead.
7. Cost to Port St. Lucie (Annual and Potential): Additional $660,983.00 for a revised Contract amount of $2,310,543.00.

Staff Recommendation: Move that the Council approve Amendment #4 to Contract #20210081 for the additional time and Grant Administration and CEI Services on behalf of the Utility Systems Department to manage the construction of the new 24-inch force main.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Amendment #4 to Contract #20210081.
2. Move that the Council not approve Amendment #4 to Contract #20210081 and provide staff with direction.
Background: The Consultant was authorized on April 11, 2022, to perform design and permitting services for Phases 1, 2 and 3, along with construction phase services for Phase 1. The scope of services for construction phase services for Phases 2 and 3 was defined in the original Contract, with the fee to be determined later. The original project for Phases 2 and 3 was to be constructed under a Construction Manager At Risk (“CMAR”) that would be developed by the City and Consultant, however, the City decided to publicly bid Phases 2 and 3 of the work, with Phase 1 being constructed by one of the CITY’s on-call contractors.
Additionally, the City was awarded a $8,762,155 grant for this Project from the Florida Department of Environmental Protection (“FDEP”) for Phases 2 and 3, requiring Grant Administration services.
The project will provide for a new 24-inch force main to divert 4.00 million gallons per day from the Southport Booster Pump Station to the Glades Booster Pump Station. This flow will bypass the Westport Wastewater Treatment Facility and be transferred to the Glades Wastewater Treatment Facility. This Amendment provides for additional services that will assist the Utility Systems Department in Grant Administration, project management and construction inspections.
Issues/Analysis: Staff has reviewed the proposal and recommends Kimley-Horn and Associates, Inc. continue with the design of the 24-inch force main.
Financial Information: Funds are appropriated in the Utility CIP Fund / Westport WWTP / Improvements O/T Building / Westport Expansion (#448-3512-563000-Y1728).
