Executive Summary (General Business): Request for approval of a Preliminary Plat and Final Plat that is approximately 28.56 acres in area for a project known as Southern Grove Plat No. 48.

 

Presentation Information: N/A

 

Staff Recommendation: Move that the Council approve the Preliminary and Final Plat as recommended by the Site Plan Review Committee and, in accordance with Section 156.023 of the Subdivision Code, find that the literal enforcement of Chapter 156 is impracticable or will exact undue hardship because of peculiar conditions pertaining to the land, and provide a waiver to the requirement that all lots be accessed via a paved public or private street and to allow access to Parcel B via the sixty (60) foot access and utility easement provided on Tract 1, Southern Grove Plat No. 32, and subject to the following condition:  

 

1.                     A Unity of Title combining Parcel B, Southern Grove Plat No. 48, with the abutting Tract 1, Southern Grove Plat No. 32 (Accel parcel) must be recorded immediately following the recording of the plat for consistency with City Code.   

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the request subject to the condition noted above.

2.                     Move that the Council deny the request and provide direction.

 

Background: The Site Plan Review Committee unanimously recommended approval of this Preliminary and Final subdivision plat on November 13, 2024.
