3. Purpose: To authorize Hazen to proceed with advisory services during the design phase of the Discovery Water Treatment Facility Progressive Design-Build Project.
4. New/Renewal/Modified: Modified.
5. Duration: The original Contract expires August 12, 2028. No additional time is needed for the services under Amendment #1, and therefore, Amendment #1 adds no additional Contract time.
6. Benefits to Port St. Lucie: The Owner’s Representative will oversee the Progressive Design-Builder (PDB) during the preconstruction phase, including project management, design review, permitting support, preconstruction services, and funding and grant assistance. These tasks support the Utility Systems Department (USD) in negotiating future project phases and ensure the PDB has current system information needed to design and build the most effective facility.
7. Cost to Port St. Lucie (Annual and Potential): An additional $1,440,280.00 plus $975,000.00 in optional additional services for a new Contract amount of $1,639,300.00 plus $975,000.00 in optional additional services.

Staff Recommendation: Move that the Council approve Amendment #1 to Contract #20250065 for an Owner’s Representative for the Design-Build Project of the New Water Treatment Facility (Discovery) and Related Improvements.

2. Move that the Council not approve Amendment #1 to Contract #20250065 and provide staff with direction.
Background: USD is preparing to construct a new water treatment facility at the existing site known as Range Line Booster Pumping Station to meet future potable water demands. The project is being delivered using a progressive design-build approach. To support this effort, Hazen was selected as the Owner’s Representative through Request for Proposals (RFP) #20250065. This role provides USD staff with access to specialized expertise, current industry advancements, and dedicated advocacy throughout the project. The work associated with Amendment #1 will enable the Owner’s Representative to oversee the PDB during the preconstruction phase, including project management, design review, permitting support, preconstruction services, and funding and grant assistance. Approval of Amendment #1 maintains continuity with the competitively procured Owner’s Representative already supporting the project, avoiding the cost, schedule delays, and loss of institutional knowledge associated with selecting a new firm mid-project. These tasks support USD in negotiating future project phases and ensure the PDB has current system information needed to design and build the most effective water treatment facility.
Issues/Analysis: The proposed fee, structured as a lump sum with not-to-exceed hourly components consistent with the base contract, reflects the level of effort required for design and preconstruction support. An allowance of $975,000.00 of optional additional services has been included. Potential additional services may include but are not limited to: Support for the Design-Builder Public Outreach Planning, Distribution System Data Update, Distribution System Hydraulic Model Development, and Water Use Permit Renewal.
Services performed under the additional services allowance shall be billed on an agreed upon amount as authorized by the City, subject to the limits set in the Contract. These additional services would be effective upon issuance of a Notice to Proceed (“NTP”) signed by the City Project Manager. The cost for these services, unless in excess of the amount approved by Council herein ($975,000) and City Code of Ordinances, Section 35.09, would not be brought back to Council for additional approval.
Financial Information: Funds are appropriated in the Utility Systems CIP Fund / Discovery ROWTP - 10.0 MGD / Improvements-Design (#448-3313-563004-25USD015P).
Special Consideration: As the Discovery Water Treatment Facility project progresses through the design-build phases, future Amendments to authorize Owner’s Representative services will be placed on future Council agendas as necessary for approval prior to commencing the work required to oversee upcoming project phases.
