3. Purpose: Preserve the City’s right to secure mitigation for impacts on city infrastructure resulting from development of the project known as Palermo Estates, which is located to the west of Rangeline Road.
4. New/Renewal/Modified: New
5. Duration: Through issuance of final residential unit certificate of occupancy for Palermo Estates.
6. Benefits to Port St. Lucie: provides coordination regarding development of Palermo Estates and secures construction of certain roadway link prior to commencement of residential development within Palermo Estates.

Staff Recommendation: Move that the Council approve the Developer Agreement

Background: The City is actively monitoring development activity to the west of Rangeline Road to ensure that the city has the assurance that projects will mitigate their impact on city infrastructure. Palermo Estates, while in St. Lucie County, depends in large part on roadways planned but not yet built in the City of Port Saint Lucie for connectivity and capacity. For this reason, the City has worked with the developer to negotiate an agreement that provides that S.W. Discovery Way will be constructed and open to the public, at a minimum as two (2) lane roadways, prior to the Palermo Estates developer applying for building permits. Additionally, the Developer Agreement provides more certainty relating to mitigation of impacts to the City’s roadway network at the future development phases of the project (Rezoning, Site Plan, etc). A copy of the agreement is attached.
