Strategic Plan Link: The City’s Mission to be responsive to our community.

Summary Brief (General Business): ABC Liquors, Inc., the owner of 2091 SW Gatlin Blvd, Port St. Lucie, Florida, is requesting to abandon the existing Access and Utility Easement, which was recorded in Official Records Book 1701, at Page 1611, of the Public Records of St. Lucie County, Florida. The Access and Utility Easement was granted so the City could access, operate, and maintain its public utility facilities located in the easement area. The Utility lift station has been removed and the easement is no longer needed.

Presentation Information: N/A

Staff Recommendation: Move that the Council approve the Ordinance to abandon the existing Access and Utility Easement located at 2091 SW Gatlin Blvd, Port St. Lucie, Florida.

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the abandonment of the easement.

2.                     Move that the Council not approve the abandonment and provide staff direction.

Background: Lots 1 and 2, Block 1714, Port St. Lucie Section Thirty-One, are encumbered by an Access and Utility Easement and since the existing Utility lift station has been removed and will be relocated, the easement is no longer needed.

Issues/Analysis: The request to abandon existing Access and Utility Easement was evaluated by the Public Works Department, Utility Systems Department, and the Public Utility Companies (AT&T, Comcast, and Florida City Gas). The City Departments and Utility Companies have no objection to the abandonment of the existing Access and Utility Easement.

Financial Information: There will be no cost incurred by the City.

Special Consideration: The abandonment of the existing Access and Utility Easement is needed for construction and development of the site. A new utility easement will be provided as part of the close out of the project, when the facilities are turned over to the City.

Location of Project: 2091 SW Gatlin Blvd.
