2. Parties: City of Port St. Lucie and Kimley-Horn and Associates, Inc.
3. Purpose: To ratify the previous amendments and approve the additional scope of work required for environmental monitoring and additional design revisions.
4. New/Renewal/Modified: Modified.
5. Duration: Amendments #7 through #11 did not add any additional Contract time. Amendment #12 adds about ten (10) months of Contract time, making the new Contract expiration date November 1, 2027.
6. Benefits to Port St. Lucie: To amend the scope of work to include the required South Florida Water Management District (SFWMD) wetland monitoring and reporting, update the maintenance building plans, revise the electrical and security plans associated with the MUSCO lighting changes, coordinate related on-site plan revisions, and add the requested 300 LF of roadway milling and resurfacing to the off-site plans.
7. Cost to Port St. Lucie (Annual and Potential): Ratify Amendment #7 for $4,500.00; ratify Amendment #8 for $14,500.00; ratify Amendment #9 for $19,500.00; ratify Amendment #10 for $5,750.00; ratify Amendment #11 to add federal language at no additional cost; and approve Amendment #12 for an additional $58,850.00. The total for these Amendments is $103,100.00 which exceeds the threshold requiring Council approval. If approved, the new Contract Compensation total would be $2,417,620.00.

Staff Recommendation: Move that the Council ratify Amendments #7 through #11 and approve Amendment #12 with Kimely-Horn and Associates, Inc. for Design & Permitting Services for a New Regional Park Facility on Torino Parkway.
Alternate Recommendations:
1. Move that the Council amend the recommendation and ratify Amendments #7 through #11 and approve Amendment #12 to Contract #20220036.
2. Move that the Council not ratify Amendments #7 though #11 nor approve Amendment #12 to Contract #20220036 and provide staff with direction.
Background: Kimley-Horn and Associates, Inc. is the Engineer of Record (EOR) and the consultant responsible for the existing Torino Regional Park design and permitting documents. Amendment #12 provides for the Consultant to complete the required SFWMD wetland monitoring and reporting, update the maintenance building plans, revise the electrical and security plans associated with the MUSCO lighting changes, coordinate related on-site plan revisions, and add the requested 300 LF of roadway milling and resurfacing to the off-site plans. Continuing the work under the existing Contract provides for continuity and allows the required revisions and environmental work to move forward without introducing a new consultant into the project.
Amendment #11 - provided for the additional terms required to pay eligible design costs with APRA funds. No additional funds were needed for this Amendment.
Amendment #10 - provided for the additional costs to prepare and support the City’s Grant application. The additional cost was $5,750.00.
Amendment #9 - provided for additional Gopher Tortoise permitting and relocation services. This also included a Cultural Resources Assessment Survey, for a total additional amount of $19,500.00.
Amendment #8 - provided for the survey and permitting services for the Gopher Tortoise relocation prior to the start of construction. The initial services were in the amount of $14,500.00.
Amendment #7 - provided for the Future Land Use designation of the “Matilda” parcel. The additional cost for this service was $4,500.00.
The combined costs of Amendments #7 through #12 is $103,100.00, which exceeds the threshold described further in the Issues/Analysis Section, and now requires Council approval. This Amendment will extend the Contract time to November 1, 2027.
Issues/Analysis: City Council approval is needed for Amendment #12. Since the previous Amendments were under the City Council threshold pursuant to City Code of Ordinances, Section 35.09(b) (“For any existing contracts, previously approved by City Council, the City Manager, or his or her designee(s), shall have the discretion, power, and authority to approve increases (1) up to 25% of the original contract price or (2) $99,999.99, whichever is less, for non-construction contracts. . . . The aggregate total of any increases of a contract must stay within the thresholds of this subsection.”), and its predecessor ordinance, until Amendment #12, staff is requesting City Council approval under Section 35.09(c) (“Any charges in excess of the aforementioned amounts may be made only when authorized by the City Council.”). Staff has reviewed the proposed changes described herein and found them to be fair and reasonable.
