Executive Summary (General Business): The City’s Business Tax Division requests amendment to Section 158.217 (F) of the City’s Code, due to the Florida Statutes creating Section 559.995 pertaining to home-based businesses and preempts areas of regulation for home-based businesses.

 

Presentation Information: Yvonne White Grayson, Business Tax Manager, will be available for questions.

 

Staff Recommendation: Move that the Council approve the revision to the Ordinance.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and apply the revision to the Ordinance.

2.                     Move that the Council provide staff with direction.

 

Background: Section 158.217 (F) - Home Occupation of the City Code, was enacted to provide specific conditions under which a home-based business could operateFlorida Statutes 559.995 was enacted by the legislature and became effective July 1, 2021 and authorizes a home-based business to operate in a residential zone under certain circumstances and prohibits a local government from certain actions relating to the license and regulation of home-based businesses; authorizes specified business owners to challenge certain local government actions; authorizes the prevailing party to recover specified attorney fees and costs.
