3. Purpose: To ensure budget alignment for the completion of Contract #20250180 for the Construction of O.L Peacock, Sr., Park.
4. New/Renewal/Modified: Modified.
5. Duration: The initial term began on October 30, 2025, through July 30, 2026. Amendment #2 extended the Contract for an additional 4-months, through November 30, 2026. Amendment #3 does not include any extension.
6. Benefits to Port St. Lucie: To enhance O.L. Peacock, Sr., Park’s functionality, accessibility, and overall visitor experience by adding essential facilities and infrastructure that support safe and convenient public use.
7. Cost to Port St. Lucie (Annual and Potential): The original Contract amount was $1,973,971.59. Amendment #1 added an additional $98,698.58 to bring the total cost to $2,072,670.17. Amendment #2 added an additional $408,169.90, resulting in a current total contract cost of $2,480,840.07. Amendment #3 will add $209,493.42, bringing the Contract total to $2,690,333.49.

Background: O.L. Peacock Sr., Park, is a priority project in the City’s Strategic Plan under Goal 6, which focuses on culture, nature, and recreation. The park currently serves the neighborhood with a lake that provides fishing and kayak access. The original construction contract was approved on October 29, 2025. It included a paved walking trail, a new playground, and two shade pavilions. During the design and early construction phase, it was determined that a permanent restroom facility was needed to better support visitors. Amendment #2 added a restroom, office, and concession building along with a commercial grinder system, utility connections, walkway links, and other site improvements.
As construction progressed, change orders were issued to address tree removals and replacements, fencing removal and installation, asphalt grinding and overlay, site grading, electrical system upgrades for the future restroom building, new concrete pads and walkways, drainage improvements, and temporary landscape support. The combined value of these change orders is $308,192.00. The City previously approved a contingency of $98,698.58, which has been fully used to offset part of these costs. The remaining balance of $209,493.42 must be added to the Contract so the remaining change order work can be paid.
Issues/Analysis: The cumulative funds that will be added to the Contract under Amendment #3 require City Council approval under City Code of Ordinances, Section 35.09(b) and (c). Section 35.09(b) mandates that “for any existing contracts, previously approved by City Council, the City Manager, or his or her designee(s), shall have the discretion, power, and authority to approve increases . . . (1) up to 25% of the original contract price or (2) $199,999.99, whichever is less, for construction contracts. The aggregate total of any increases of a contract must stay within the thresholds of this subsection.” Section 35.09(c) states “any charges in excess of the aforementioned amounts may be made only when authorized by the City Council.”
