1.                     Prepared by: Midway Glades Developers, LLC

2.                     Parties: City of Port St. Lucie and Midway Glades Developers, LLC

3.                     Purpose: These easements are required to construct a new Floridian Well F-19 and future utility mains and fiber optic communication.

4.                     New/Renewal/Modified: New

5.                     Duration: The well site easement term is perpetual, and the temporary access easement terminates upon construction of the permanent access easement or five years from the date of execution.

6.                     Benefits to Port St. Lucie: Allows the City to provide an additional location for a potable water well to the northwest portion of the City for higher water quality.

7.                     Cost to Port St. Lucie (Annual and Potential): Costs are contingent.

Staff Recommendation: Move that the Council approve the execution of the Temporary Access Easement and Well Site Easement agreement between the City and Midway Glades Developers, LLC.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the execution of the Temporary access Easement and Well Site Easement agreement between the City and Midway Glades Developers, LLC.

2.                     Move that the Council not approve the easements and provide staff further direction.

 

Background:  The City of Port St. Lucie (City) owns and operates the James E. Anderson Water Treatment Plant (JEA WTP). The facility treats brackish groundwater with reverse osmosis membranes to provide potable water to the City’s customers. The brackish water is supplied by the JEA wellfield. The City is proposing the design and construction of a new Floridan Aquifer supply well in the JEA wellfield. This new well will allow for increased operational and maintenance flexibility. This well will not increase the total volume of water being removed from the aquifer for treatment and beneficial use. The Temporary Access and Well Site Easement agreement are needed to proceed with the construction of the new well and future utilities. 

 

Issues/Analysis: N/A

                     

Financial Information: There is no funding required at this time.

 

Special Consideration: There was considerable time and effort in negotiations with Midway Glades Developers, LLC to reach this point of the agreements. Staff feels it is important to execute the easements in order to allow the Project to proceed forward.
