Summary Brief (Agreements/Contracts only)

2.                     Parties: City of Port St. Lucie and CHA Consulting, Inc. (“CHA”) formerly known as Reiss Engineering, Inc.

3.                     Purpose:   The City has requested CHA proceed with preliminary engineering, permitting, final design, bidding, and construction services for the proposed Nutrient Reduction Improvements to comply with the new basin management action plan (“BMAP”) regulations and to meet high-level disinfection requirements.

4.                     New/Renewal/Modified: Modified

5.                     Duration: 1,260 days to complete the Scope of Services.

6.                     Benefits to Port St. Lucie: Improvements shall ultimately result in a greater finished product (effluent) from the Westport Wastewater Treatment Facility (“WWTF”). Said improvements shall reduce the nitrogen concentration as required by the Florida Department of Environmental Protection (“FDEP”) and will also incorporate upgrades to equipment and processes that will aid in the reduction of odors. 

7.                     Cost to Port St. Lucie (Annual and Potential): In summary, the total amount of the original contract with Reiss Engineering, Inc. (#20170132) and all prior amendments total $4,037,090.75. The additional funds being requested for this Amendment is $1,173,033.47. If approved, this would thereby raise the total amended contract amount to $5,210,124.22.

Background:   During the bidding phase for Part 2, new effluent treatment standards were established by FDEP for public access reuse (“PAR”) in the January 2020, St. Lucie River and Estuary Basin Management Action Plan (“BMAP”). The BMAP established PAR annual average effluent treatment standards for total nitrogen of 10 mg/L and total phosphorus of 6.0 mg/L which require the City to adjust the improvements needed at the facility. CHA Consulting, Inc. completed a Nutrient Reduction Study in August 2021 that evaluated various process improvements/additions to meet the new BMAP effluent limits. The Study concluded that proceeding with the existing Modified Ludzack Ettinger (“MLE”) treatment process improvements, as identified in the May 2021 Basis of Design Report, would allow the City to meet the BMAP effluent limits, for nitrogen, at the time of the Westport WWTF’s next permit renewal. Engineer will assist the City in the implementation of the Westport WWTF Improvements project. This Contract authorizes the Engineer to perform preliminary engineering, permitting, final design, bidding, and construction phase services for making improvements to the plant to meet the treatment needs of the Westport service area. This scope is based on an anticipated treatment need to meet the following capacities, as provided by the City:

 

                     5.36 MGD Annual Average Day Flow

                     6.00 MGD Maximum Month Average Day Capacity

                     7.93 MGD Peak Day Capacity

 

Issues/Analysis: The City will engage the services of a Construction Manager at Risk (“CMAR”) to provide construction services for the main project. CHA will work collaboratively with the selected CMAR and City to develop the final design to a 100 percent level of completion. The construction documents shall be complete and be usable for competitive bids of the construction trade contracts by the CMAR and subsequent construction of the Project.

                     

Financial Information: In summary, the total amount of the original contract (#20170132) and all prior amendments total $4,037,090.75. The total “additional funds” requested is $1,173,033.47. If approved, this would thereby raise the total amended contract to $5,210,124.22. Prior approved funds were still available since the Part 2 expansion was halted when unforeseen changes by FDEP were implemented as described in the background portion of the amendment.

 

Special Consideration: Approval is required to keep this project on schedule to meet regulatory compliance deadline of January 2025.
