Staff Recommendation: Move that the Council approve the Resolution authorizing the acceptance of a donation of real property described as Tract C, Southern Grove Plat 39, as Recorded in Plat Book 109, Page 30, of the Public Records of St. Lucie County, Florida.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Resolution authorizing the acceptance of a donation of real property described as Tract C, Southern Grove Plat 39, as Recorded in Plat Book 109, Page 30, of the Public Records of St. Lucie County, Florida.

2.                     Move that the Council not approve the acquisition and provide staff direction.

 

Background: A request for approval of Alternative Equivalent Proposal for Public Art was presented to City Council and approved by Resolution 23-R21 for the “Tree of American Dreams” sculpture proposed by the Sansone Group, LLC to satisfy the Public Art requirement for Legacy Park. Due to the artwork’s original proposed location (corner of Anthony F. Sansone Sr. Boulevard and Becker Road) being owned by Southern Grove CDD No.5, a condition of approval required a license agreement between the Sansone Group, LLC, and the Southern Grove CDD No. 5 that addressed access, ownership, maintenance, operations, and other requirements. The developer and the CDD could not come to terms, therefore a license agreement was unattainable.

 

Issues/Analysis: The donation of Tract C to the City of Port St. Lucie provides a location for the artwork to be freely accessible on publicly owned land.

                     

Financial Information: There is no financial impact.

 

Special Consideration: This is a companion item to 2024-947 presented to the Governmental Finance Corporation.

 

Location of Project: The real property to be acquired by the City is located at the southeast corner of SW Village Parkway and Hegener Drive.
