Executive Summary (General Business): The applicant proposes installation of “Dreaming Cloud,” a series of powder-coated aluminum sculptures by artist Gustavo Oviedo, inspired by cloud motifs. The artwork presented reflects the installations for Buildings 1 and 2 within Phase I, while artwork for Buildings 3 and 4 will be installed in Phases II and III.

Staff Recommendation: Move that the Council adopt the resolution to approve the artwork as recommended by the Public Art Advisory Board.

Background: The applicant requested an extension to hire an artist and develop an on-site artwork installation concept, rather than contribute to the public art fund as originally proposed.

 

To ensure a complete submittal for coordinated artwork across the project’s four proposed building walls, staff requested that the renderings for all building walls be submitted as part of this application.

 

The proposed artwork, “Dreaming Cloud,” created by artist Gustavo Oviedo qualifies as a permitted work of art under Chapter 162, meeting the ordinance definition of sculpture as an original, tangible work created by a professional artist. All private development meeting the applicability requirements of the City’s public art ordinance is subject to a public art assessment of one percent of the total dollar amount of a project’s total construction costs. The applicant has selected option 1, to provide on-site artwork.

 

Issues/Analysis: The Public Art Advisory Board reviewed the on-site public art proposal at its June 15, 2026, meeting and recommended approval, finding that the artwork satisfied the criteria in Sec. 162.09(1)-(5).  The Dragonfly project consists of four warehouse spec buildings divided into three phases.  Phase I improvements total $15,117,328, resulting in a 1% public art assessment of $151,173.30 that is capped at $100,000 per the public art ordinance.

 

Phase I includes Buildings 1 and 2, which will receive the first installations upon project completion. The applicant has also submitted conceptual renderings for Buildings 3 and 4, which will be installed in Phase II and Phase III in accordance with the project’s construction and Certificate of Occupancy schedule. This ensures that the public art requirement is fully met, and a site-wide, cohesive design is achieved.

 

The artwork will be mounted on the building façade, centered within a 22-foot structural bay on a façade approximately 66 feet wide. As a sculptural installation, it is attached to the stem walls that screen mechanical equipment. The sculptures will project approximately 6 inches from the façade and will be backlit with white lighting to enhance the blue tones of the sculpture.

                     

Financial Information: Although Chapter 162 assesses the full public art requirement at the time of site plan approval, the project is being constructed in clearly defined phases, and the public art obligation is allocated proportionally as each phase is built. Phase I includes Building 1 and Building 2, each contributing $25,000 toward the total public art requirement for a combined $50,000 artwork cost. The approved artwork for these two buildings will be installed upon approval of this public art application. Buildings 3 and 4 will be constructed in Phase II and Phase III, each contributing $25,000 toward the total public art requirement for a total artwork value of $100,000. The applicant has provided conceptual artwork renderings for all four buildings, and the remaining public art installations for the remaining two buildings will be due prior to Certificate of Occupancy, consistent with Chapter 162.

Location of Project: The property is located at SW Tom Mackie Boulevard, generally located west of Interstate 95, east of SW Village Parkway, south of Trade Center Drive, north of the Marshall Parkway Road right-of-way, and on the west side of Tom Mackie Boulevard.
