2. Parties: City of Port St. Lucie and FDEP.
3. Purpose: Request an extension of the Agreement due to delays caused by a faulty electric actuator which requires removal and reinstallation.
4. New/Renewal/Modified: Modified.
5. Duration: Change the Date of Expiration to March 31, 2026.
6. Benefits to Port St. Lucie: Enhanced water quality.
7. Cost to Port St. Lucie (Annual and Potential): Control Structure SWW-1 Rehabilitation Project: The project’s total construction cost is $561,300.69, of which $224,520.28 is funded by the City of Port St. Lucie and approximately 60% percent, not to exceed $336,780.41, is funded through the State Water-Quality Assistance Grant. Annual operating costs and match requirements will be provided by the Public Works Department.

Staff Recommendation: Move that the Council approve Amendment No. 2 to Agreement No. NS082 and authorize the City Manager to enter into and execute Amendment No. 2.
Alternate Recommendations:
1. Move that the Council amend the recommendation and approve Amendment No. 2 to Agreement No. NS082.
2. Move that the Council not approve Amendment No. 2 to Agreement No. NS082 and provide staff with direction.
Background: The original Grant Agreement went before City Council by Resolution 21-R105 at the August 23, 2021, City Council Meeting and was approved. A first amendment was entered into in July of 2023 for an extension of time.
This project will modify the SWW-1 control structure to treat runoff from 504.5 acres of tributary drainage basins. The SWW-1 structure controls flow between the Tiffany Basin (control elevation 10.5 NAVD) and the Blackwell Basin (of the City of Port St. Lucie Eastport SWM System). The project will slow, spread, soak, and filter water before it discharges into Warner Creek and the North Fork of the St. Lucie River.
Issues/Analysis: A project scope and schedule are detailed in the attached agreements.
Financial Information: The match and operating costs are accounted for in the Public Works department budget.
Special Consideration: There are several critical milestones in the second amended agreement that have been reviewed and agreed upon by the departments.
