Summary Brief: The owners of Lots 13, 14, 15, 16, 17 and 18, Block 1706, Port St. Lucie Section Thirty-One (the “subject property”) are requesting to abandon a portion of the twenty (20) foot wide rear utility easement. The easement abandonment request is because part of the pre-existing building is located within the twenty (20) foot wide utility easement.

 

Presentation Information: N/A

 

Staff Recommendation: Move that the Council approve the Ordinance abandoning a portion of the twenty (20) foot wide utility easement located at the subject property.

 

Alternate Recommendations:

1.                     Move that the Council amend the recommendation and approve the Ordinance abandoning a portion of the twenty (20) foot wide utility easement located at the subject property. 

2.                     Move that the Council not approve the abandonment and provide staff direction.

 

Background: The subject property was platted with a twenty (20) foot wide rear utility easement. The owners have a pre-existing building located six (6) feet into the rear twenty (20) foot utility easement. The owners of the subject property have submitted a request for the abandonment to the City.

 

Issues/Analysis: The request to abandon a portion of the easement was evaluated by the Public Works Department, Utility Systems Department, and the applicable Public Utility Companies (FPL and Florida City Gas). The City Departments and Utility Companies have no objection to the abandonment of a portion of the twenty (20) foot utility easement located at the subject property.

 

Financial Information: There will be no cost incurred by the City.

 

Special Consideration: N/A   

 

Location of Project: The property is located at Lots 13, 14, 15, 16, 17 and 18, Block 1706, Port St. Lucie Section Thirty-One.
