Executive Summary (General Business): This amendment to Title III - "Administration," Chapter 35 - Finance; Purchasing, of the Ordinances of the City of Port St. Lucie, Florida, is proposed to update the City's procurement ordinance to comply with state law and protect the City's cybersecurity, security, and firesafety information.

Background: Effective July 1, 2022, State Law was enacted to exempt certain cybersecurity information from public records and/or public meetings. Florida Statutes also provides similar exemptions for certain security and firesafety information. These laws protect sensitive information and enhance the ability to maintain effective security and safety positions. The proposed amendment to Title III - "Administration," Chapter 35 - Finance; Purchasing, of the City Code is proposed to update the City's procurement ordinance to comply with state law and protect the City's cybersecurity, security, and firesafety interests.
Issues/Analysis: Current procurement processes require transparency, which can inadvertently expose sensitive cybersecurity, security, and firesafety details. The proposed exemption from formal bidding in the amended Ordinance will allow for secure handling of this sensitive information during the procurement process. Exemption of this information also allows for budget allocations for cybersecurity, security, and firesafety to be protected and used effectively without compromising security interests. This exemption will align the City's Information Technology (IT) policies with state requirements and enhance the security of the City's IT infrastructure by safeguarding sensitive information, reducing the risk of cybersecurity and safety threats. Additionally, the Ordinance grants the City Manager an additional threshold approval authority for these purchases, with safeguards to ensure purchases meet all requirements. The proposed updates to the Ordinance will streamline board agenda processes by clearly defining the exemptions and ensure compliance with state law while maintaining transparency in other areas.
